Tinjauan Yuridis Terhadap Penetapan Ahli Waris yang Dinyatakan Cacat Hukum oleh Pengadilan (Studi Putusan Nomorr : 591/Pdt/G/2014/PN.Mdn)

Abstract

Nowadays there is often an inheritance dispute problem that often creates problems in the family in everyday life. Inheritance problems often arise because of one of the heirs feel less satisfied with the division of inheritance that they receive. The issues to be reviewed in this review are: 1. How is the arrangement of the determination of the heirs deemed legally defective by the Court in accordance with the Verdict No. 591/pdt.6 /2014 / PN.Mdn. 2. How is the procedure for determining heirs in the District Court. 3. How the impact on defected determination of the Heirs. In Decision No. 1061 / Pdt.P / 1987 / PN.Mdn, stated that on October 13, 1987, Ny. Kuidah Malem Maha acknowledge that Antoni Singarimbun (Biological father of the Plaintiff / Jimmy Leonid Lukas Antonius Singarimbun, SH.) and Defendant I to IV is the biological child of Kunci Singarimbun with Madam Kuidah Malem Maha. However, in Decision No. 1061 / Pdt.P / 1987 / PN.Mdn is not mentioned the position of the plaintiff as the only child of Antoni Singarimbun. Because of the fatcs above, the plaintiff filed a lawsuit to the Medan District Court on December 15, 2014 which was registered at the Registrar of the Medan District Court on December 15, 2014, with Registry No. 591 / Pdt.G / 2014 / PN.Mdn. The legal consequences of the defected determination of the Heirs is a declaration that the decision is neither binding nor void. The above mentioned fact can be seen in the Medan District Court Verdic No. 591/pdt.6/2014/PN.Mdn, on November 7, 1987 The heir of Alm. Kunci Singarimbun and Almh. Kuidah Malem Maha containing flawed law and therefore must be declared not have binding legal force with issuance of the Medan District Court Verdic No. 591/Pdt.G/2014/PN.Mdn.
