Abstract

Legal arrangements regarding criminal acts of counterfeiting in the regulations of the Law on Military Discipline and knowing the application of criminal law in military justice to criminal acts Forgery of self-marriage data documents in decisions Number 44-K / PM.I-02 / AD / IV / 2018 This research held at Military Court I-02 Medan. Based on this, the authors formulated the problem, namely how the legal regulations against members of the TNI who falsified their personal data based on Law Number 25 of 2014, and how the Military Police's efforts against TNI members committed Crime of Forgetting Personal Data Marriage. The research method is carried out by means of data retrieval, namely by taking a copy of the decision regarding the problem of criminal acts of forgery of personal data documents carried out by persons (Indonesian National Army) TNI. The author also conducts library research, which examines the data obtained through literature, documents, and other laws and regulations that are relevant to the object of research. The results of the study show that the application of criminal law to perpetrators of criminal acts of fraud in the examination of the decision number : 44K / PM.I-02 / AD / IV / 2018, the defendant was charged with using charges, namely Article 263 paragraph (2) of the Criminal Code and Article 279 paragraph (1) of the Criminal Code. Furthermore, the legal consideration of the judge in imposing criminal sanctions on the defendant in the decision Number 44-K / PM.I-02 / AD / IV / 2018 of the defendant in a criminal sentence with 10 (ten) months imprisonment and charged with paying court fees for being legally proven and convincingly commit criminal acts of forgery.
