Tanggung Jawab Hukum Penyewa Terhadap Kerusakan Kios atau Toko di Pusat Pasar Medan (Studi Perusahaan Daerah Pasar Pusat Pasar Kota Medan)

Abstract

The legal responsibility of the tenant to damage the kiosk or shop that is leased by the market trader in the Medan market center refers to an agreement between the parties. But in this case, if there is damage caused by a natural disaster, it will be borne by the Regional Market Company, whereas if the damage is caused by the tenant, the tenant is obliged to make repairs to the damaged kiosk or shop. Based on this, the formulation carried out by the researcher is how the legal structure of the responsibility of renting a kiosk or shop in the Medan Central Market Market by the Regional Market Company, how is the responsibility for damage to the kiosks or stores of the Regional Company to the Central Market traders. The research method used is a research that is empirical juridical analysis with qualitative descriptive data and library research (Library Research) about leasing agreements and field research, namely interviews related to leasing agreements. While the results of the study from the following discussion are the legal rules regarding leasing responsibilities, which are not able to add a roof without permission, leaving the sale on a public road that is not specifically for that, selling goods that are not in accordance with a rented stand or kiosk. Damage to the Market will be repaired by the Regional Company but if the damage occurs due to the disaster and does not pay contributions and provided a shelter for temporary selling, if the damage is done by the tenant then the tenant is obliged to repair the rented kiosk or stand.
