Abstract: | A work agreement is an agreement where the party is one. Labor, bind themselves to work by receiving wages on the other party, the employer, who binds himself to work on the laborer by paying wages. The purpose of holding a collective labor agreement (PKB) in PDAM Tirtanadi North Sumatra is the implementation of Law No. 13 of 2003. With the creation of a collective labor agreement (PKB) it is intended as a reference in regulating industrial relations between PDAM Tirtanadi employees and management of PDAM Tirtanadi regulating the employment cycle in PDAMs from recruitment to retirees. The problem in this research is how the process of guiding collective labor agreements between workers and companies in PDAM Tirtanadi North Sumatra and what are the rights and obligations of the parties in the collective labor agreement between workers and companies of PDAM Tirtanadi North Sumatra. The research method used is library research, namely by conducting research on various reading sources, namely books, legal magazines, opinions of scholars, law regulations and also lecture materials. Field research (Field Research), namely by doing spaciousness in this case the author immediately conducted field studies in PDAM Tirtanadi North Sumatra by conducting interviews with related parties. The process of the collective labor agreement in the PDAM Tirtanadi company before the end of the company's contract period was reported to the directors to request approval, after the agreement to renew their contract, and after they agreed they signed, the company returned and signed by the head of the HR division as representative of the company's directors. The rights and obligations of the parties in the collective labor agreement in the PDAM Tirtanadi company, namely the First Party has the right to supervise work procedures, procedures and administrative procedures that apply in the First Party office or places where the Second Party carries out its work. or indirectly to carry out its work and the First Party has the right to give a warning or sanction to the Second Party if the Second Party is proven to violate the applicable regulations in the First Party, so the second party must be willing to accept sanctions from the first party. |
Description: | Perjanjian kerja adalah suatu perjanjian dimana pihak kesatu. Buruh, mengikatkan diri untuk bekerja dengan menerima upah pada pihak lainnya, majikan, yang mengikatkan diri untuk mengerjakan buruh itu dengan membayar upah. Tujuan di adakannya perjanjian kerja bersama (PKB) di PDAM Tirtanadi Sumatra Utara merupakan pelaksanaan dari Undang-Undang Nomor 13 Tahun 2003. Dengan dibuatnya perjanjian kerja bersama (PKB) maka dimaksudkan sebagai acuan dalam mengatur hubungan industrial antara karyawan PDAM Tirtanadi dan menajemen PDAM Tirtanadi yang mengatur siklus ketenagakerjaan di PDAM mulai dari rekriutmen hingga pensiunan. Permasalahan dalam penelitian ini adalah bagaimana proses pembutan perjanjian kerja bersama antara pekerja dan perusahaan di PDAM Tirtanadi Sumatera Utara dan apa saja Hak dan kewajiban para pihak dalam perjanjian kerja bersama antara pekerja dan perusahaan PDAM Tirtanadi Sumatera Utara. Metode penelitian yang digunkan adalah penelitian kepustakaan (Library Research) yaitu dengan melakukan penelitian terhadap berbagai sumber bacaan yaitu buku-buku, majalah hukum, pendapat para sarjana, peraturan undang-undang dan juga bahan-bahan kuliah. Penelitian lapangan (Field Research) yaitu dengan melakukan kelapangan dalam hal ini penulis langsung melakukan studi kelapangan di PDAM Tirtanadi Sumatera Utara dengan melakukan wawancara ke pihak terkait. Proses perjanjian kerja bersama di perusahaan PDAM Tirtanadi sebelum berakhirnya masa kontrak perusahaan dilaporkan ke direksi untuk memohon persetujuan, setelah nanti dapat persetujuan tindak perpanjang lagi kontrak mereka, dan setelah mereka sepakat mereka tanda tangan, baru balik lagi keperusahaan dan ditanda tangani oleh kepala devisi SDM sebagai wakil dari direksi perusahaan. Hak dan kewajiban para pihak dalam perjanjian kerja bersama dalam perusahaan PDAM Tirtanadi yaitu Pihak Pertama berhak mengawasi prosedur kerja, tata tertib dan tata cara administrasi yang berlaku di kantor Pihak Pertama atau tempat-tempat dimana Pihak Kedua melaksanakan pekerjaannya, Pihak Pertama berhak memberikan perintah secara langsung atau tidak langsung untuk melaksanakan pekerjaannya dan Pihak Pertama berhak memberikan peringatan atau sanksi kepada Pihak Kedua apabila Pihak Kedua terbukti melanggar peraturan yang berlaku di Pihak Pertama maka pihak kedua harus bersedia menerima sanksi dari pihak pertama. |
