Peran Polri dalam Penanggulangan Tindak Pidana Kekerasan dalam Rumah Tangga (Studi pada Polsek Medan Area)

Abstract

The purpose of this study was to determine the regulation of the role of the police in the prevention of domestic violence (KDRT) according to Law Number 23 of 2004 on the Elimination of Domestic Violence, the role of the police in the prevention of domestic violence in the Medan District Police Area, and factors that influence the role of the police in handling Domestic Violence (KDRT) in Medan Area Sector Police. The method used in this research is normative juridical which refers to legal norms and principles contained in legislation and policies on acts of violence in household (library legal research) and empirical jurisdiction to examine the policy implications of eliminating acts of violence in household. The type of data used in normative juridical research is secondary data sourced from library research while the type of data for empirical research is primary data sourced from questionnaires. The results of this study conclude that the role of the police which is very important in providing temporary protection, providing protection to victims also has the authority to take various other actions in relation to enforcement and prevention efforts both in relation to preventive and repressive functions (investigation process), the aim is among others so that victims avoid more influence or pressure, both from the husband's side or other parties so that they are not free to provide information. The Police in Medan Area Sector Police, as investigators in handling cases of Domestic Violence (KDRT) are conducted according to criminal proceedings by referring to Law Number 23 of 2004 concerning the Elimination of Domestic Violence. Medan Area Sector Police has one of the Medan Area Sector Police programs in reducing / overcoming acts of domestic violence, namely: (1) RKS program (solution consultation room), (2) Sector field police officers closer to residents. Factors influencing the role of the police in Medan Area Police in overcoming Domestic Violence in gathering adequate preliminary evidence, because in general violence experienced by the victim is not witnessed by anyone other than the victim himself who experienced violence. In addition there are also obstacles encountered due to the attitude or behavior of the victim himself. after the arrest and detention and examination of witnesses in connection with acts of domestic violence which resulted in the victim being seriously injured and reported by the victim himself, the victim then begged the investigator so that the investigation process was stopped and not proceed to prosecution on the grounds the victim felt sorry for the suspect, still loves the suspect and has forgiven his mistakes. When the investigator gave an explanation that the cessation of the investigation could not be carried out because there was sufficient evidence of the act of violence and there was no reason to stop the investigation as stated by the defendant.
