dc.description | Salah satu tujuan perjanjian ASEAN-China Free Trade Area (ACFTA) adalah mengurangi hambatan perdagangan barang khususnya dari sisi tarif (Agreement on Trade in Goods). Degan ACFTA tarif yang berlaku secara umum (Most Favoured Nation) diubah menjadi tarif lebih kecil atau bahkan ditiadakan, yang disebut dengan tarif preferensi (preferential tariff). Untuk mendapatkan tarif preferensi, ACFTA menyepakati adanya ketentuan Rules of Origin (ROO). ROO mengatur ada tiga kriteria yang harus dipenuhi untuk memperoleh tarif preferensi yaitu Kriteria Origin (Origin criteria), Kriteria Pengiriman (Consigment Criteria), Kriteria Prosedural (Procedural Criteria). Kriteria Prosedural diatur di Operational Certification Procedures (OCP) dalam Attachment A ROO. OCP juga mengatur mengenai prosedur pengisian Surat Keterangan Asal (SKA) (certificate of origin) dimana intisarinya tertuang dalam lembar sebalik (overleaf notes) Form E. Dalam penerapan OCP ACFTA di Indonesia, ada pihak yang beranggapan kesalahan dalam penerapan OCP ACFTA dianggap sebagai kesalahan yang dapat diabaikan (minor discrepancies). Penelitian dilakukan dengan pendekatan yuridis normatif dengan teknik pengumpulan data melalui library research dan field research, dengan kesimpulan bahwa kesalahan dalam penerapan OCP ACFTA tidak bisa dianggap sebagai kesalahan yang dapat diabaikan (minor discrepancies). Penelitian OCP ACFTA dilakukan untuk memastikan ketiga kriteria ROO sudah dipenuhi, sehingga dapat memperoleh tarif preferensi. | en_US |
dc.description.abstract | One of the purpose ASEAN-China Free Trade Area (ACFTA) agreement is deducted of trade in goods barrier, as specifically for tariff (Agreement on Trade in Goods). ACFTA treatment is reduction from the MFN tariff, but not necessarily zero tariffs, it’s called preferential tariff. Preferential tariff is rifer to Rules of Origin (ROO). There are three criteria ROO shall be applied to preferential tariff accept, first Origin criteria, second Consignment Criteria, third Procedural Criteria. Procedural Criteria means as regulated as Operational Certification Procedures (OCP) in Attachment A ROO. OCP regulated how to apply certificate of origin, several regulation is written in overleaf notes Form E. In Indonesian OCP ACFTA application, there has opinion that OCP ACFTA missing is minor discrepancies. Research conducted in this thesis is normative juridicial, data was collected with library research and field research method the research state that the opinion is field, OCP ACFTA is important things to guarantee that three criteria ROO shall applied, to preferential tariff accepted. | en_US |
