dc.descriptionSistem pelelangan secara online melalui internet (e-auction) menjadi terobosan dari sistem pelelangan secara konvensional. Tetapi juga bisa memberi peluang bagi pihak yang tidak bertanggung jawab untuk mengambil keuntungan, sehingga perlu ditegaskan dimana letak perlindungan hukum bagi pembeli selaku pihak yang paling lemah posisinya. Tujuan penelitian ini Untuk: 1) Untuk mengetahui, mengkaji dan menganalisa perlindungan hukum bagi pembeli sebagai pemenang lelang dalam proses pelaksanaan lelang eksekusi hak tanggungan melalui internet (e-auctions), 2) mengetahui, mengkaji dan menganalisa proses pelaksanaan lelang eksekusi hak tanggungan melalui internet (e-auctions), 3) Untuk mengetahui, mengkaji dan menganalisa kepastian hukum bagi para pihak dalam lelang eksekusi hak tanggungan melalui internet (e-auctions). Penelitian yang digunakan adalah jenis penelitian hukum normatif, yang dilakukan untuk mendapatkan data dari bahan-bahan kepustakaan terutama yang berhubungan mengenai masalah hukum yang dilakukan dengan cara meneliti bahan hukum primer, dan sekunder. Tipe penelitian adalah deskriptif analisis dengan pendekata yuridis normatif dimana penelitian ini memberikan gambaran secara rinci, sistematis dan menyeluruh segala sesuatu yang berhubungan dengan perlindungan hukum bagi pembeli selaku pemenang Lelang dalam proses pelaksanaan lelang eksekusi Hak Tanggungan melalui e-auction. Hasil penelitian: 1) Proses pelaksanaan lelang hak tanggungan secara eauction telah memberikan perlindungan hukum bagi pembeli/ pemenang. 2) Proses pelaksanaan lelang secara e-auction yaitu proses pelaksanaan lelang yang dilakukan melalui media (internet maupun surat elektronik) terbuka untuk umum, dilakukan tanpa kehadiran peserta lelang dihadapan pejabat lelang dan pejabat penjual dengan disaksikan oleh 2 (dua) orang saksi dengan penawaran tertulis, yang terdiri dari proses pra lelang, Pelaksanaan Lelang dan Pasca Lelang. 3) Pelaksanaan lelang hak tanggungan secara eauction juga telah memberikan kepastian hukum bagi penjual/kreditur, debitur maupun pemenang lelang/pembeli.en_US
dc.description.abstractThe online auction system through the internet (e-auction) became a breakthrough of the conventional auction system. But it can also provide an opportunity for those who are not responsible for taking advantage, so it is necessary to emphasize where the legal protection is for buyers as the weakest party. The purpose of this study is to: 1) To find out, review and analyze legal protection for buyers as auction winners in the process of auctioning execution security Right Over Land via the internet (e-auctions), 2) find out, review and analyze the process of carrying out the auction of execution of security Right Over Land via the internet (e-auctions), 3) To find out, review and analyze legal certainty for the parties in the auction of execution of e-auctions. The research used is a type of normative legal research, which is carried out to obtain data from library materials, especially those relating to legal issues that are carried out by examining primary and secondary legal materials. This type of research is descriptive analysis with a normative juridical approach where this research provides a detailed, systematic and thorough description of everything related to legal protection and legal certainty in the auction of execution of Underwriting Rights through e-auction. Research results: 1) The process of auctioning the security riht over land by e-auction has provided legal protection for the buyer / winner. 2) The auction implementation process by e-auction, namely the process of conducting an auction conducted through the media (internet or e-mail) open to the public, carried out without the presence of bidders before auction officials and sales officials witnessed by 2 (two) witnesses with a written offer, which consists of the pre-auction process, Implementation of Auction and Post-Auction. 3) The auction of mortgage rights by e-auction has also provided legal certainty for sellers / creditors, debtors and auction winners/ buyers.en_US
