| Abstract: | The crime of trafficking in persons (human trafficking) is a crime that is very complex so it is difficult to eradicate. The cases of trafficking in persons usually do not only involve one side of life but from various other aspects of life. The crime of trafficking in persons also consists of various types whose level of crime equally violates other human rights. However, attention to trafficking in persons is more focused on women as a vulnerable group in talks (women trafficking). Related to this problem, research is needed on how the linkages between trafficking in persons and sexual service providers are women victims. The purpose of this research is to see more clearly that there is still a link between the criminal acts of service providers for commercial sex workers and the crime of trafficking in persons. The author's approach in this research is descriptive qualitative, that is research based on phenomena or realities that exist in the research field relating to trafficking in persons by commercial sex workers. The results of this study describe how the relationship between the crime of trafficking in persons with the crime of commercial sex worker service providers whose victims are women. |
| Description: | Tindak pidana perdagangan orang (human trafficking) merupakan salah satu tindak pidana yang sangat kompleks sehingga sulit untuk diberantas. Kasus-kasus tindak pidana perdagangan orang biasanya tidak hanya menyangkut satu sisi kehidupan tetapi dari berbagai sisi kehidupan lainnya. Tindak pidana perdagangan orang juga terdiri dari berbagai macam jenis yang tingkat kejahatannya samasama melanggar hak asasi manusia lainnya. Namun, perhatian tindak pidana perdagangan orang lebih dikhususkan pada perempuan sebagai kelompok kaum rentan dalam pembicaraan ini (women trafficking). Terkait dengan masalah tersebut, perlu penelitian tentang bagaimanakah keterkaitan diantara tindak pidana perdagangan orang terhadap penyedia jasa pekerja seksual yang kaum perempuan sebagai korban. Adapun tujuan dari penelitian ini yaitu untuk melihat lebih jelas bahwa tetap ada keterkaitan antara tindak pidana penyedia jasa pekerja seks komersial dengan tindak pidana perdagangan orang. Metode pendekatan yang penulis lakukan dalam penelitian ini adalah deskriptif kualitatif, yaitu penelitian yang berlandaskan pada fenomena-fenomena atau realiti yang ada di lapangan penelitian yang berkaitan dengan tindak pidana perdagangan orang oleh penyedia pekerja seks komersial. Hasil dari penelitian ini menguraikan bagaimana kaitan diantara tindak pidana perdagangan orang dengan tindak pidana penyedia jasa pekerja seks komersial yang korbannya adalah perempuan. |
