dc.description | Tenaga kerja mempunyai peranan dan kedudukan yang sangat penting dalam pembangunan nasional. Sesuai dengan peranan dan kedudukan tenaga kerja, diperlukan pembangunan ketenagakerjaan untuk meningkatkan kualitas dan peran sertanya dalam penbangunan serta peningkatan perlindungan tenaga kerja dan keluarganya sesuai dengan harkat dan martabat kemanusiaan. Berdasarkan hal tersebut Permasalahan dalam penelitian ini adalah: bagaimana aturan hukum tentang pemutusan hubungan kerja menurut undang-undang No. 13 Tahun 2003 tentang ketenagakerjaan, bagaimana tanggung jawab perusahaan terhadap hak-hak pekerja akibat pemutusan hubungan kerja yang terjadi pada Putusan No. 366/Pdt.Sus-PHI/2017/PN.Mdn dan bagaimana pertimbangan hakim dalam pemberian putusan pada Putusan No. 366/Pdt.Sus-PHI/2017/PN.Mdn. Tujuan penelitian adalah mengkaji tentang yuridis terhadap uang pesangon. Metode penelitian yang digunakan adalah adalah yuridis normatif yaitu jenis penelitian yang dilakukan dengan mempelajari norma-norma yang ada atau peraturan perundang-undangan yang terkait dengan permasalahan yang dibahas. Sifat penelitian yang dipergunakan dalam menyelesaikan skripsi ini adalah deskriptif analis,dengan menggunakan studi dokumen kepustakaan dan melakukan wawancara, Analisis data yang dilakukan secara kualitatif induktif. Adapun hasil penelitian berdasarkan rumusan masalah diatas adalah: Aturan hukum tentang pemutusan hubungan kerja yang diatur dalam undang-undang ketenagakerjaan yaitu Pasal 158 Undang-Undang No. 13 Tahun 2003 tentang ketenagakerjaan, dan proses penyeleaiannya Undang-Undang No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Tanggung jawab jika terjadi pemutusan hubungan kerja berdasarkan Putusan No. 366/Pdt.Sus-PHI/2017/PN.Mdn dan Pasal 161 ayat (3) Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, Tergugat harus membayar uang pesangon sebesar 1 (satu) kali ketentuan Pasal 156 ayat (2), uang penghargaan masa kerja sebesar 1 (satu) kali ketentuan Pasal 156 ayat (3) dan uang penggantian hak sesuai ketentuan Pasal 156 ayat (4) Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan kepada “Penggugat”. Pertimbangan hakim dalam pemberian putusan pada Putusan No. 366/Pdt.Sus-PHI/2017/PN.Mdn adalah Penggugat merasa dipaksa dan di intimidasi oleh pimpinannya untuk membuat kronologis sesuai kemauan pimpinan atau membuat kronologis tidak sebagaimana mestinya, setelah mendengar gugatan dari penggugat disertai jawaban dari tergugat serta melihat bukti-bukti yang diajukan para pihak selama proses persidangan Serta Pasal 161 ayat (3) Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan maka Majelis hakim mengabulkan gugatan penggugat dan mendapatkan kembali hak-haknya. | en_US |
dc.description.abstract | Manpower has a very important role and position in national development. In accordance with the role and position of the workforce, employment development is needed to improve the quality and participation in development and increase the protection of workers and their families in accordance with human dignity and dignity. Based on this, the problem in this study is: how is the rule of law regarding termination of employment according to law No. 13 of 2003 concerning manpower, how the company's responsibility for workers' rights due to termination of employment that occurred in Decision No. 366 / Pdt.Sus-PHI / 2017 / PN.Mdn and how judges considerations in granting decisions on Decision No. 366 / Pdt.Sus-PHI / 2017 / PN.Mdn. The purpose of this study is to examine juridical severance pay. The research method used is normative juridical, which is the type of research conducted by studying existing norms or legislation related to the issues discussed. The nature of the research used in completing this thesis is descriptive analyst, using the study of literature documents and conducting interviews, data analysis conducted qualitatively inductive. The research results based on the formulation of the problem above are: Legal rules regarding termination of employment regulated in the labor law namely Article 158 of Law No. 13 of 2003 concerning manpower, and the process for its completion. Law No. 2 of 2004 concerning Settlement of Industrial Relations Disputes. Responsibility in case of termination of employment based on Decision No. 366 / Pdt.Sus-PHI / 2017 / PN.Mdn and Article 161 paragraph (3) of Law No. 13 of 2003 concerning Manpower, the Defendant must pay severance pay in the amount of 1 (one) time under Article 156 paragraph (2), a period of service reward money of 1 (one) time in Article 156 paragraph (3) and compensation for compensation in accordance with Article 156 Paragraph (4) Law No. 13 of 2003 concerning Manpower to the "Plaintiff". Judge's consideration in awarding verdict on Decision No. 366 / Pdt.Sus-PHI / 2017 / PN.Mdn is the Plaintiff feels compelled and intimidated by his leadership to make chronologically according to the wishes of the leader or make chronologically not as it should, after hearing the plaintiff's claim accompanied by answers from the defendant and see the evidence that is submitted by the parties during the trial process As well as Article 161 paragraph (3) of Law No. 13 of 2003 concerning Manpower, | en_US |
