Tinjauan Yuridis Penangguhan Pelaksanaan lelang Oleh Debitur Terhadap Objek Hak Tanggungan (Studi Kasus Putusan Nomor : 6616/Pdt.G/2016/PN.Mdn)

Abstract

Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dan sifat penelitian ini adalah bersifat penelitian deskriptis analisis sedangkan analisis data yang dipergunakan adalah analisis kualitatif. Pengaturan tentang lelang dan hak tanggungan diatur dalam Peraturan Menteri Keuangan Nomor 93/PMK.06/2010 yang kemudian telah dirubah menjadi Peraturan Menteri Keuangan Nomor 27/PMK.06/2016 dan Pasal 6 Undang-Undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan sebagai sarana untuk mempercepat pelunasan piutang debitur wanprestasi. Prosedur gugatan oleh debitur terhadap objek hak tanggungan jika dalam proses lelang eksekusi hak tanggungan merasa dirugikan dapat menempuh jalur hukum yaitu mengajukan gugatan ke Pengadilan Negeri untuk mendapatkan keadilan. Akibat hukum gugatan penangguhan pelaksanaan terhadap lelang eksekusi hak tanggungan pada prinsipnya tidak menunda pelaksanakan eksekusi hak tanggungan, tetapi ternyata memberikan dampak yuridis dan ekonomis yang besar. Tujuan gugatan penangguhan terhadap pelaksanaan lelang semata-mata bertujuan untuk mempersulit pemegang Hak Tanggungan dalam menyelesaikan piutangnya secara cepat. Putusan atas gugatan dan perlawanan dapat mengakibatkan penundaan lelang yang akan dilaksanakan. An auction is the sale of goods open to the public with increasing written or oral price bids to reach the highest price preceded by an auction announcement. The principle contained in the auction is the principle of openness, which means that all people are aware of the auction plan and have the same opportunity to participate in the auction as long as it is not prohibited by law. The formulation of the problem in this research is how the arrangement of the auction and mortgage rights, how the procedure of a lawsuit by the debtor against the object of mortgage rights, what are the consequences of the auction cancellation lawsuit. The type of research used in this research is normative legal research and the nature of this research is descriptive analysis research, while the data analysis used is qualitative analysis. The regulation regarding auction and security rights is regulated in the Minister of Finance Regulation Number 93 / PMK.06 / 2010 which has subsequently been amended to the Minister of Finance Regulation Number 27 / PMK.06 / 2016 and Article 6 of Law Number 4 of 1996 concerning Mortgage Rights as a means to speed up settlement of default debtor receivables. The procedure for a lawsuit by the debtor against the object of the mortgage right if in the auction process the execution of the mortgage right feels aggrieved can take legal action, namely to file a lawsuit to the District Court to get justice. The legal consequence of a lawsuit against execution of the auction for execution of mortgage rights in principle does not delay the execution of mortgage rights, but in fact has a large juridical and economic impact. The purpose of the postponement lawsuit against the auction is solely aimed at making it difficult for Mortgage holders to settle their receivables quickly. Decisions on lawsuits and challenges may result in postponement of the auction that will be held.
