Peran Kepolisian Daerah Sumut Dalam Pemberantasan Prostitusi Online Sebagai Bentuk dan Modus Perdagangan Manusia

Abstract

Perkembangan Iptek dan Informasi Internet telah membawa dampak pada perkembangan kejahatan di masyarakat. Kejahatan prostitusi yang konvensional saat ini telah memanfaatkan teknologi untuk modus kejahatannnya dengan bantuan media sosial internet. Perkembangan prostitusi online saat ini sudah menghkawatirkan, sehingga perlu dilakukan penegakan hukum oleh Lembaga Kepolisian sebagai penyidik. Berdasarkan hal tersebut, penelitian ini memfokuskan kajian pada aturan hukum, modus pelaku prostitusi online dan peran Kepolisian dalam memberantas prostitusi online. Tipe penelitian menggunakan metode penelitian yuridis normatif dengan melakukan kajian terhadap norma-norma hukum yang ada. Metode pengumpulan data dengan cara studi kepustakaan (library reseach). Permasalahan yang dikaji dengan metode analisis kualitatif. Hasil dari penelitian menjelaskan pertaman, bahwa pengaturan hukum mengenai praktik prostitusi online dalam sistem hukum di Indonesia tidak diatur dengan tegas baik dalam KUHPidana sebagai lex generalis hukum pidana Indonesia. Pengaturan hukum yang dapat menjerat pelaku prostitusi online hanya dapat menjerat mucikarinya, atau PSK nya apabila terbukti melanggar ketentuan Peraturan Pasal Pasal 27 UU NO.11 Tahun 2008, Pasal 4, Pasal 29-Pasal 37 UU No. 44 Tahun 2008, Pasal 5, Pasal 8, Pasal 47 UU No. 23 Tahun 2004 serta Pasal 2 ayat (1) UU No. 21 tahun 2007. Kedua, bahwa Modus terjadinya praktik prostitusi online di Indonesia khususnya di Sumatera Utara adalah dengan memanfaatkan jaringan internet dalam bentuk website, Forum, Aplikasi Media Sosial sebagai sarana iklan atau promosi praktik prostitusi. Dengan memanfaatkan ruang internet tersebut, mucikari membuat kesepakan dengan pengguna untuk bertransaksi prostitusi melalui online, dan apabila terjadi kesepakatan maka PSK akan dikirimkan ketempat yang dituju atau yang dipesankan oleh Pengguna Jasa prostitusi. Ketiga, bahwa Peran Kepolisian Daerah Sumatera Utara dalam memberantas praktik prostitusi online adalah dengan melakukan tindakan preventif (pencegahan) hal ini dilakukan dengan fokus pada tindakan sosialisasi bahaya dan dampak yang ditimbulkan dari prostitusi online. Sedangkan dalam rangka melaksanakan fungsi represif maka Polda Sumut menekankan pada pelaksanaan peraturan perundang-undangan yaknni dengan melakukan penerimaan laporan masyarakat, penyelidikan, penyidikan, dan penangkapan serta pemeriksaan para pelaku prostitusi online. The development of Internet Science and Technology and Information has had an impact on the development of crime in society. Conventional prostitution crime has now used technology for its mode of crime with the help of internet social media. The development of online prostitution is now worrying, so law enforcement is needed by the Police Institution as an investigator. Based on this, this study focuses on the study of the rule of law, the mode of online prostitution and the role of the Police in eradicating online prostitution. This type of research uses normative juridical research methods by conducting a review of existing legal norms. Methods of collecting data by means of library research (library reseach). Problems are examined by qualitative analysis methods. The results of the study explain first, that the legal regulation regarding the practice of online prostitution in the legal system in Indonesia is not well regulated in the Criminal Code as lex generalis of Indonesian criminal law. Legal arrangements that can ensnare online prostitutes can only ensnare their pimps, or their prostitutes if it is proven to violate the provisions of Article Article 27 of Law No. 11 of 2008, Article 4, Article 29-Article 37 of Law No. 44 of 2008, Article 5, Article 8, Article 47 of Law No. 23 of 2004 and Article 2 paragraph (1) of Law No. 21 of 2007. Second, that the mode of occurrence of the practice of online prostitution in Indonesia, especially in North Sumatra is by utilizing the internet network in the form of websites, forums, social media applications as a means of advertising or promotion of the practice of prostitution. By utilizing the internet space, pimps make arrangements with users to transact prostitution online, and if an agreement occurs, the prostitute will be sent to the place of destination or ordered by the users of prostitution services. Third, that the role of the North Sumatra Regional Police in eradicating the practice of online prostitution is to take preventive measures (prevention), this is done by focusing on the socialization of hazards and the effects of online prostitution. Meanwhile, in order to carry out repressive functions, the North Sumatra Regional Police emphasized the implementation of legislations by accepting public reports, investigations, investigations, and arrests and examinations of online prostitutes.
