Peranan Kepolisian Dalam Penanggulangan Tindak Pidana Terorisme (Studi Pada Polda Sumut)

Abstract

Keberadaan kepolisian sangat esensial dalam penanggulangan tindak pidana terorisme, karena kepolisian terstruktur sedemikian rupa dari daerah sampai ke pusat dan sesuai pula dengan tugas dan fungsi polisi dalam menciptakan keamanan masyarakat serta penegakan hukum. Permasalahan yang diajukan dalam penelitian ini adalah: bagaimana kewenangan kepolisian dalam penanggulangan tindak pidana terorisme, bagaimana faktor-faktor yang mempengaruhi terjadinya tindak pidana terorisme dan bagaimana hambatan Polda Sumut dalam dalam penanggulangan tindak pidana terorisme. Penelitian ini diarahkan kepada penelitian hukum yuridis normatif, atau doktriner yang juga disebut sebagai penelitian perpustakaan atau studi dokumen, karena lebih banyak dilakukan terhadap data yang bersifat sekunder yang ada di perpustakaan. Hasil penelitian dan pembahasan menjelaskan kewenangan kepolisian dalam penanggulangan tindak pidana terorisme adalah kewenangan yang didapatkan berdasarkan undang-undang yaitu meliputi Undang_undang No. 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana, Undang- Undang No. 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia dan Undang-Undang Nomor 5 Tahun 2018 Tentang Perubahan Atas Undang-Undang Nomor 15 Tahun 2oo3 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2002 Tentang Pemberantasan Tindak Pidana Terorisme Menjadi Undang-Undang. Dengan kewenangan tersebut kepolisian memiliki tugas dalam pelaksanaan penanggulangan terorisme bekerjasama dengan TNI dan instansi lainnya serta masyarakat. Faktor-faktor yang mempengaruhi terjadinya tindak pidana terorisme meliputi: faktor Pemikiran dari pelaku, faktor ekonomi, faktor politik, faktor sosial, faktor psikologis dan pendidikan yang salah. Hambatan Polda Sumut dalam dalam penanggulangan tindak pidana terorisme adalah kurangnya sinergitas antara Polda Sumut dengan instansi-instansi terkait dalam penanggulangan teroris sehingga penanggulangan terorisme masih bersifat parsial atau terpisah. Selain itu terjadi perbedaan persepsi mengenai teroris antara Polda Sumut dengan TNI dan Densus 88. The existence of the police is very essential in the handling of criminal acts of terrorism, because the police are structured in such a way from the region to the center and in accordance with the duties and functions of the police in creating public security and law enforcement. The problems raised in this study are: how is the authority of the police in the handling of criminal acts of terrorism, how are the factors that influence the occurrence of criminal acts of terrorism and how the obstacles of the North Sumatra Police in the handling of criminal acts of terrorism. This research is directed to normative juridical legal research, or doctrinaire which is also referred to as library research or document study, because more is done on secondary data in the library. The results of the study and discussion explaining the authority of the police in the prevention of criminal acts of terrorism is the authority obtained under the law, which includes Law No. 8 of 1981 concerning the Criminal Procedure Code, Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia and Law Number 5 Year 2018 concerning Amendments to Law Number 15 Year 2oo3 concerning the Establishment of Government Regulations in lieu of Law Number 1 of 2002 concerning Eradication of Criminal Acts of Terrorism into Law. With this authority the police have a duty in implementing counter-terrorism in collaboration with the TNI and other agencies and the public. Factors that influence the occurrence of criminal acts of terrorism include: Thought factors of the perpetrators, economic factors, political factors, social factors, psychological and educational factors that are wrong. The obstacle of the North Sumatra Regional Police in the handling of criminal acts of terrorism is the lack of synergy between the North Sumatra Regional Police and the related agencies in counter terrorism so that counter-terrorism is still partial or separate. In addition, there were differences in perceptions regarding terrorists between North Sumatra Regional Police and the TNI and Detachment 88.
