Abstract: | Guru adalah pahlawan pendidikan. Meskipun demikian dalam melaksanakan profesinya guru sering kali dihadapkan pada peristiwa kriminalisasi khususnya kekerasan. Kondisi ini tentunya amat sangat riskan dalam kaitannya dengan penguatan pendidikan. Permasalahan yang diajukan dalam penelitian ini adalah: bagaimana perlindungan hukum terhadap guru dalam proses pendidikan terkait tindak pidana kekerasan, bagaimana pertanggungjawaban pidana pelaku kekerasan dalam proses pendidikan terkait tindak pidana kekerasan dan bagaimana upaya yang dilakukan dalam penanggulangan kekerasan dalam proses pendidikan terkait tindak pidana kekerasan. Penelitian ini diarahkan kepada penelitian hukum yuridis normatif, atau doktriner yang juga disebut sebagai penelitian perpustakaan atau studi dokumen, karena lebih banyak dilakukan terhadap data yang bersifat sekunder yang ada di perpustakaan. Hasil penelitian dan pembahasan menjelaskan perlindungan hukum terhadap guru dalam proses pendidikan terkait tindak pidana kekerasan sudah diatur secara lengkap dalam berbagai perundang-undangan seperti Undang-Undang Nomor 14 Tahun 2005 Tentang Guru dan Dosen dan Peraturan Pemerintah Nomor 74 Tahun 2008 Tentang Guru. Dimana dijelaskan dalam kedua perundang-undangan tersebut penghukuman maupun pemberian sanksi terhadap siswa dengan tujuan pengajaran yang dilakukan guru bukan merupakan tindak pidana kekerasan. Pertanggungjawaban pidana pelaku kekerasan dalam proses pendidikan terkait tindak pidana kekerasan adalah adanya perbuatan guru dalam proses pembelajaran tidak sesuai atau melanggar undang-undang yang berlaku, aturan, atau ketentuan mengenai kedisiplinan dan tata tertib di kelas atau sekolah, kemudian perbuatan yang dilakukannya tersebut mengandung kesengajaan (maksud jahat), kealpaan yang sangat besar, kesembronoan, dan pengabaian hak-hak atau keselamatan/keamanan anak didik. Selanjutnya adalah tidak adanya alasan pemaaf atas perilaku guru yang melakukan kekerasan dalam proses pembelajaran terhadap anak. Upaya yang dilakukan dalam penanggulangan kekerasan dalam proses pendidikan terkait tindak pidana kekerasan meliputi pengawasan/kontrol. Bagi guru yang melakukan kekerasan terhadap siswa maka akan menimbulkan akibat yaitu dikenakan sanksi pidana, sanksi pidana yang dijatuhkan adalah berupa pidana penjara serta pembinaan/sosialisasi adalah suatu bentuk paya penanggulangan kekerasan di lingkungan pendidikan dalam proses pembelajaran dengan cara mensosialisasikan kepada pengajar bahwa pengajar dapat dikenakan sanksi dalam Undang-Undang Perlindungan Anak dan KUHP apabila melakukan kekerasan dalam proses pembelajaran. The teacher is a hero of education. Nevertheless, in carrying out his profession, teachers are often faced with criminalization, especially violence. This condition is certainly very very risky in relation to strengthening education. The problems raised in this study are: how to protect the law against the teacher in the education process related to the crime of violence, how the criminal responsibility of perpetrators of violence in the education process is related to criminal acts of violence and how efforts are made in dealing with violence in the education process related to violent crime. This research is directed to normative juridical legal research, or doctrinaire which is also referred to as library research or document study, because more is done on secondary data in the library. The results of the study and discussion explaining the legal protection of teachers in the education process related to criminal acts of violence has been fully regulated in various laws such as Law Number 14 of 2005 concerning Teachers and Lecturers and Government Regulation Number 74 of 2008 concerning Teachers. Where explained in both legislation, the punishment and sanction of students with the purpose of teaching carried out by the teacher is not a crime of violence. The criminal responsibility of the perpetrator of violence in the education process related to criminal acts of violence is the existence of the teacher's actions in the learning process is not appropriate or violates applicable laws, rules, or provisions regarding discipline and order in the class or school, then the actions that they carry contain intentions ( evil intentions), enormous neglect, carelessness, and neglect of the rights or safety / security of students. Furthermore, there is no forgiving reason for the behavior of teachers who commit violence in the learning process for children. Efforts made in overcoming violence in the education process related to violent crime include supervision / control. For teachers who commit violence against students it will result in the effect of being subject to criminal sanctions, criminal sanctions imposed are in the form of imprisonment as well as coaching / socialization is a form of overcoming violence in the education environment in the learning process by socializing to the instructor that the teacher can be penalized in the Child Protection Act and the Criminal Code when committing violence in the learning process. |
