Peranan Unit Jibom Sat Brimob Poldasu Dalam Penindakan Terorisme di Polda Sumatera Utara

Abstract

Unit Jibom adalah salah satu unit di Subden Brimob dan pergerakannya adalah unit. Sesuai dengan namanya maka Unit Jibom memiliki peran khusus dalam penanganan bom. Berdasarkan keadaan tersebut maka diajukan permasalahan: bagaimana aturan hukum dalam penindakan pelaku tindak pidana terorisme, bagaimana faktor penyebab terjadinya tindak pidana terorisme di wilayah Polda Sumut dan bagaimana kebijakan Unit Jibom Satbrimob Polda Sumut dalam penindakan terorisme di wilayah Polda Sumut. Jenis penelitian ini menggunakan jenis yuridis sosiologis. Jenis penelitian yuridis sosiologis dimaksudkan sebagai penelaahan dalam tataran konsepsional tentang arti dan maksud berbagai peraturan hukum nasional yang berkaitan dengan peranan Unit Jibom Sat Brimob Poldasu dalam penindakan terorisme. Berdasarkan hasil penelitian dan pembahasan diketahui aturan hukum dalam penindakan pelaku tindak pidana terorisme adalah: Kitab Undang-Undang Hukum Acara Pidana, Kitab Undang-Undang Hukum Pidana, Tindak Pidana Terorisme Menurut Undang-Undang Nomor 15 Tahun 2003, Peraturan Presiden Republik Indonesia Nomor 46 Tahun 2010 tentang Badan Nasional Penanggulangan Terorisme dan Peraturan Kepala Kepolisian Negara Nomor 11 Tahun 2010 Tentang Penanganan Penjinakan Bom. Faktor penyebab terjadinya tindak pidana terorisme di wilayah Polda Sumut adalah: ketidakadilan Sosial Secara Nasional, pemaknaan Terhadap Ayat-Ayat Kitab Suci Yang Dipersepsikan Mendukung Radikalisme, memiliki bias positif terhadap kelompoknya dan biasa negatif bagi kelompok lain, bias heuristik yang dialami para pelaku tindak terorisme dan kekecewaan terhadap praktik sistem demokrasi. 3. Kebijakan Unit Jibom Satbrimob Polda Sumut dalam penindakan terorisme di wilayah Polda Sumut dilakukan dengan berbagai upaya dan langkah-langkah ditempuh melalui penerapan peraturan-peraturan hukum dan sanksi dalam UUPTPT, serta menerapkan prosedur hukum pidana (kebijakan penal). Selain itu, Polri juga melakukan kebijakan non penal (di luar hukum pidana) dengan melakukan pendekatan terhadap akar permasalahan lahirnya persoalan terorisme dari sudut sosial. Unit Jibom Polri diupayakan sebagai bagian terdepan melakukan penindakan, intelijen, dan investigasi terhadap jaringan terorisme untuk menghadapkan pelaku teroris ke dalam persidangan dalam sistim peradilan pidana. This type of research uses a type of sociological juridical. The type of sociological juridical research is intended as a review at the conceptual level of the meaning and purpose of various national legal regulations relating to the role of the Satyr Unit of the Police Mobile Brigade in the act of terrorism. Based on the results of research and discussion it is known that the legal rules in the prosecution of perpetrators of terrorism are: Criminal Procedure Code, Criminal Code, Terrorism Crime According to Law Number 15 of 2003, Presidential Regulation of the Republic of Indonesia Number 46 Year 2010 concerning the National Agency for Combating Terrorism and the Regulation of the Head of the National Police Number 11 of 2010 concerning Handling of Bombing Arrangements. Factors that cause the occurrence of criminal acts of terrorism in the North Sumatra Regional Police are: National Social Injustice, Meaning of perceived Scriptures Supports Radicalism, has a positive bias towards the group and is usually negative for other groups, heuristic bias experienced by perpetrators of terrorism and disappointment with the practice of a democratic system. 3. The North Sumatra Regional Police Jibom Satbrimob Unit Policy in the act of terrorism in the North Sumatra Regional Police is carried out with various efforts and steps taken through the application of legal regulations and sanctions in the UUPTPT, as well as implementing criminal law procedures (reasoning policy). In addition, the Police also carry out non-criminal policies (outside criminal law) by approaching the root causes of the issue of the issue of terrorism from a social standpoint. The Polri Jibom Unit is strived to be the foremost part of carrying out prosecution, intelligence, and investigation of terrorist networks to expose terrorists to trials in the criminal justice system.
