Analisis Hukum mengenai Peran Kepolisian Dalam Penanggulangan Kejahatan Pencurian Dengan Kekerasan Terhadap Sepeda Motor (Study Pada Polrestabes Medan)

Abstract

Kepolisian Resort Kota Besar Medan memiliki wilayah hukum yang sangat luas dan oleh sebab itu maka tingkat kerawanan kejahatan jalanan memiliki peringkat tertinggi untuk kasus yang ditangani oleh pihak Kepolisian. Maka dari pada itu penulis mengajukan permasalahan dalam penelitian sebagai berikut : Bagaimana aturan hukum yang mengatur terhadap kejahatan dengan kekerasan terhadap kendaraan bermotor, faktor penyebab nya, dan kebijakan kepolisian dalam upaya penanggulangan nya. Adapun metode penelitian yang dibuat oleh penulis yaitu bersifat penelitian hukum normatif yaitu suatu penelitian dengan cara meneliti bahan pustaka atau data sekunder serta, peneliti juga menggunakan data primer yang dikenal sebagai penelitian hukum yuridis empiris. Aturan hukum yang mengatur terhadap kejahatan dengan kekerasan terhadap sepeda motor adalah KUHP pasal 362 dan pasal 365, UU RI No 2 tahun 2002 dan UU No 8 tahun 1981 tentang Hukum Acara Pidana. Faktor-faktor yang menyebabkan terjadinya kejahatan pencurian dengan kekerasan terhadap sepeda motor meliputi faktor intern dan faktor ekstern. Therefore the authors propose problems in the research as follows : what are the legal rules governing violence against motorbikes, the causes of crime of theft with violence against motorbikes and police policies in an effort to deal with theft crimes with violence against motorbikes. As for the research methods created by the author, they are normative legal research, namely a study by examining library materials or secondary data, and researchers also use primary data known as empirical juridical legal research. Therefore the results of discussions and research explain that the legal rules governing evil by violence against motorcycles are the book of the act of article 362 and article 365, the law of republic of Indonesia no 2 of 2002 on the police of the republic of Indonesia and the law no 8 of 1981 on the law of the criminal event. The factors that cause the crime of theft with violence against motorcycle include internal factors ( economic need for factors to control the stuff in the stole, the factor of opportunity ) and external factors ( legal enforcement factors, environmental factors, technology development factors )
