Abstract: Penelitian ini membahas tentang kebijakan diversi dalam penanganan perkara anak. Salah satu upaya penanganan anak sebagai pelaku tindak pidana adalah dengan menggunakan model restorative yang mengutamakan pelaksanakan diversi sebagaimana diamanatkan dalam Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak (UU SPPA). Permasalahan yang diajukan dalam penelitian ini adalah bagaimana kewajiban diversi dalam tindak pidana dengan pelaku anak menurut perundangundangan di Polsek Sunggal, bagaimana problematika yang dihadapi penyidik dalam pelaksanaan diversi di Kepolisian Sektor Sunggal dan bagaimana upaya hukum yang dilakukan penyidik di Kepolisian Sektor Sunggal untuk mengatasi problem yang muncul terkait dengan pemberlakuan diversi. Hasil penelitian dan pembahasan menjelaskan kewajiban diversi dalam tindak pidana dengan pelaku anak menurut perundang-undangan di Polsek Sunggal adalah dengan menerapkan ketentuan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak khususnya tentang konsep diversi dan restoratif justice, sehingga setiap perkara anak pelaku tindak pidana tidak harus diselesaikan melalui mekanisme peradilan yang akan memberikan stigma terhadap anak atas tindakan yang dilakukannya sebagai anak yang bermasalah dengan hukum. Problematika yang dihadapi penyidik dalam pelaksanaan diversi di Kepolisian Sektor Sunggal hingga saat ini belum maksimal karena kemampuan penyidik untuk menawarkan bentuk diversi hanya berbentuk perdamaian dan penyerahan kembali ke orang tua/wali. Bentuk diversi yang diterapkan hanya wajib lapor bagi pelaku setiap hari senin dan kamis, meski ada usaha untuk melibatkan pimpinan desa atau kelurahan dalam hal ADR dan pengawasan pelaku anak di tempat tinggalnya, dan pengawasan di sekolah kerja sama dengan Dinas Pendidikan (Sekolah Umum) dan Kementerian Agama (Madrasah).Upaya hukum yang dilakukan penyidik di Kepolisian Sektor Sunggal untuk mengatasi problem yang muncul terkait dengan pemberlakuan diversi adalah dengan mengambil langkah-langkah strategis yang dilakukan oleh Polsek Sunggal antara lain memanfaatkan forum Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A) Kota Medan untuk mencari model diversi berupa pelayanan masyarakat yang disesuaikan dengan karakteristik Kota Medan. Selain itu saat penelitian ini sedang ditulis, sedang coba dirumuskan model pelibatan masyarakat dalam proses diversi sebagaimana diatur dalam pasal 93 UU SPPA dengan melakukan sosialisasi dan penguatan kerja sama dengan organisasi kemasyarakatan dan unsur Forpimda (Forum pimpinan Daerah). This study discusses the policy of diversion in handling child cases. One of the efforts to handle children as perpetrators of crime is to use a restorative model that prioritizes the implementation of diversion as mandated in Law No. 11 of 2012 concerning the Criminal Justice System of Children (UU SPPA). The problem raised in this study is how the obligation of diversion in criminal acts with child perpetrators according to legislation in the Sunggal police station, how the problems faced by investigators in carrying out the diversion in the Sunggal Sector Police and how the legal efforts made by investigators in the Sunggal Sector Police to solve the problem what appears related to the application of diversion. The results of the study and discussion explaining the obligation of diversion in criminal acts with child perpetrators according to the legislation in the Sunggal Police Sector is to apply the provisions of Law Number 11 of 2012 concerning the Criminal Justice System of the Child specifically regarding the concept of diversion and restorative justice, so that every case of the perpetrators The criminal does not have to be resolved through a judicial mechanism that will stigmatize the child for the actions he has taken as a child who has a problem with the law. The problem faced by investigators in the implementation of diversion in the Sunggal Sector Police until now has not been maximized because the ability of the investigator to offer a form of diversion is only in the form of peace and surrender back to the parent / guardian. The form of diversion that is applied is only required to report to the perpetrators every Monday and Thursday, even though there are attempts to involve village or kelurahan leaders in terms of ADR and supervision of child perpetrators in their homes, and supervision in schools in collaboration with the Education Office (Public Schools) and the Ministry Religion (Madrasah). The legal effort carried out by the investigators in the Sunggal Sector Police to overcome the problems that arise related to the implementation of diversion is to take strategic steps taken by the Sunggal Police, among others, by utilizing the City Integrated Child and Women's Empowerment Center (P2TP2A) forum. Medan to look for diversion models in the form of community services that are tailored to the characteristics of Medan City. In addition, when this research is being written, a model for community involvement in the diversion process is being formulated as stipulated in article 93 of the SPPA Law by disseminating information and strengthening cooperation with community organizations and elements of Forpimda (Regional Leaders Forum).
