Perlindungan Hukum Terhadap Investor Pemegang Unit Penyertaan Reksadana

Abstract

A mutual funds is a place used to raise funds from the investor community to be invested in fortfolio securities by investment manager, Mutual fund products are sold in units of equity, just like gold using gram units, so mutual funds allow investors to buy in units and in the amount of Rupiah converted in units. In the management of mutual funds the possibility of investors experiencing losses is always there because of various problems, either due to the capital market situation and due to negligence or unlawful acts committed mutual fund managers. The method of this study is normative legal research with qualitative analysis that examines the application and norm of applicable law relating to legal protection to the investors of mutual fund participation unit holder. The result of this study is legal protection to the investors of mutual fund participation unit holder regulated by laws and regulations related to Capital Market (in this case Law Number 8 Year 1995) Article 4 states that "Guidance, regulation and supervision The principle of transparency in the stock market is based on Law No. 8 of 1995 mandating that issuers and / or public companies continue to exercise the principle of openness, which is implemented through the delivery of information or material facts relating to the business or its effects. Investment managers and mutual fund companies have responsibility for losses suffered by the investors of mutual fund participation unit holder. The Financial Services Authority plays a role in protecting the investors of mutual fund participation unit holder with the role of regulator and supervisor of financial services activities in the capital market according to Law Number 21 of 2011.

Reksadana adalah wadah yang di gunakan untuk menghimpun dana dari masyarakat pemodal untuk selanjutnya di investasikan dalam fortofolio efek oleh manejer investasi, Produk –produk reksadana di jual dalam satuan unit penyertaan, sama seperti emas yang menggunakan satuan gram maka reksadana memungkinkan investor membeli dalam jumlah unit maupun dalam jumlah Rupiah yang di konversi dalam unit. Dalam pengeloaan reksadana kemungkinan investor mengalami kerugian selalu saja ada dikarenakan berbagai persoalan baik disebabkan situasi pasar modal maupun karena adanya kelalaian atau perbuatan melawan hukum yang dilakukan pengelola reksanana. Metode penelitian ini adalah penelitian hukum normatif dengan analisis kualitatif yang mengkaji penerapan dan norma hukum positif yang berlaku yang berkaitan dengan perlindungan hukum terhadap investor pemegang unit penyertaan reksadana. Hasil dari penelitian ini adalah Perlindungan hukum terhadap investor pemegang unit penyertaan reksadana di atur oleh peraturan perundang-undangan yang terkait dengan Pasar Modal (dalam hal ini Undang-undang Nomor 8 Tahun 1995). tertuang dalam pasal 4 dinyatakan bahwa “ Pembinaan, pengaturan dan pengawasan Prinsip keterbukaan di pasar modal didasarkan pada Undang Undang nomor 8 tahun 1995 mengamanatkan agar emiten dan atau perusahaan publik senantiasa menjalankan prinsip keterbukaan, yang diimplementasikan melalui penyampaian informasi atau fakta material terkait usaha atau efeknya. Manejer Investasi dan perusahaan reksadana memiliki tanggung jawab atas kerugian yang dialami Investor pemegang Unit penyertaan reksadana. Otoritas Jasa Keuangan berperan melindungi investor pemegang unit penyertaan reksadana dengan peranan sebagai pengatur dan pengawas kegiatan jasa keuangan dipasar modal menurut Undang-Undang No. 21 tahun 2011.
