Abstract: | Apabila Debitur tidak melakukan apa yang diperjanjikan, akan ia telah melakukan wanprestasi. Menurut pasal 1238 KUHPerdata dinyatakan bahwa : “Siberhutang lalai, atau apabila dengan surat perintah atau dengan sebuah akta sejenis itu telah dinyatakan lalai, atau demi perikatannya sendiri ialah jika ini menetapkan bahwa siberhutang harus dianggap lalai dengan lewatnya waktu yang ditentukan.” Dalam penelitian ini peneliti akan meneliti tanggungawab hukum bagi debitur yangwanprestasi keterjadianatau kasus yangditeliti diambil dalam putusan Nomor No.409/Pdt.G/2016/PN Mdn., merupakan perkara gugatan wanprestasi. Jenis penelitian yang penulis teliti adalah dengan bentuk studi dokumen/kepustakaan. Hasil Penelitian ini Berkaitan dengan putusan No. 409/Pdt.G/2016/PN.Mdn, perbuatan debitur telah terbukti melakukan wanprestasi yaitu tidak melakukan prestasi sesuai dengan yang dimaksud dalam perjanjian hutang piutang. Wanprestasi dalam hal ini dapat dikarenakan usaha debitur mengalami kegagalan, sehingga tidak dapat memenuhi kewajiban prestasinya sesuai dengan Pasal 1238 KUHPerdata. Dari uraian maka bentuk wanprestasi yang dilakukan debitur yaitu tidak melakukan prestasi dan upaya penyelesaian kasus tersebut didasarkan atas peraturan perundang-undangan yang berlaku di Indonesia sehingga hakim memutuskan perkara dengan seadil-adilnya dan juga hakim dalam menjatuhkan putusan dengan berdasarkan keyakinannya dan hati nurani. Pengaturan hukum tentang kontrak utang piutang di Indonesia diatur dalam Pasal 1754 KUHPerdata bahwa pinjam-meminjam adalah persetujuan dengan mana pihak kreditur memberikan kepada pihak yang lain (debitur). Pertanggungjawaban hukum bagi debitur yang wanprestasi dalam kontrak hutang piutang adalah debitur yang telah melakukan dapat meminta pemenuhan prestasi, menuntut prestasi disertai ganti rugi kepada debitur, dapat menuntut dan meminta ganti rugi, hanya mungkin kerugian karena keterlambatan, dapat menuntut pembatalan perjanjian dan dapat menuntut pembatalan disertai ganti rugi kepada debitur. Ganti rugi berupa pembayaran uang denda Saran Penelitian ini agar sebelum melakukan perjanjian utang piutang para pihak memahami benar isi dari perjanjian dan segala konsekuensi yang dihadapi. Agar dalam perjanjian utang piutang para pihak memenuhi kewajiban masingmasing sampai dengan berakhirnya perjanjian sehingga tidak ada pihak yang dirugikan. Agar para pihak jika timbul perselisihan hendaknya terlebih dahulu diselesaikan secara musyawarah. Jika dengan musyawarah tidak tercapai kata sepakat barulah dilakukan melalui pengadilan. In this study, researchers will examine legal responsibility for debtors whose achievements or cases under study were taken in decision Number 409 / Pdt.G / 2016 / PN Mdn., A case of default. The type of research that the author studies is in the form of document / literature study. The results of this study are related to decision No. 409 / Pdt.G / 2016 / PN.Mdn, the debtor's actions have been proven to have defaulted, namely not performing as stated in the accounts payable agreement. Default in this case can be due to the debtor's business failure, so that he cannot fulfill his performance obligations in accordance with Article 1238 of the Civil Code. From the description, the form of default carried out by the debtor, namely not making any achievements and efforts to resolve the case are based on the prevailing laws and regulations in Indonesia so that the judge decides the case fairly and also the judge in making a decision based on his conviction and conscience. The legal arrangement regarding debt and receivable contracts in Indonesia is regulated in Article 1754 of the Civil Code that lending and borrowing is an agreement with which the creditor gives to another party (the debtor). Legal liability for debtors who are in default in the accounts payable contract is a debtor who has been able to request fulfillment of achievements, demands performance accompanied by compensation to the debtor, can claim and ask for compensation, only possible loss due to delay, can demand cancellation of the agreement and can demand cancellation accompanied by compensation to debtors. Compensation in the form of payment of a fine Suggestion This research is so that before entering into a debt agreement, the parties understand correctly the contents of the agreement and all the consequences faced. So that in the payable agreement the parties fulfill their respective obligations until the end of the agreement so that neither party is harmed. So that the parties if a dispute arises should first be resolved by deliberation. If consensus cannot be reached, then it is done through the court. |
