Abstract: | Penyebab terjadinya PHK ditimbulkan oleh berbagai faktor yakni disebabkan oleh pihak pegawai ataupun pihak perusahaan, dan ada pula yang disebabkan oleh perihal diluar kendali kedua pihak. Pemutusan hubungan kerja didefinisikan sebagai berhentinya hubungan kerja secara permanen antara perusahaan dengan karyawannya, sebagai perpisahan antara perusahaan dan pekerja, perpindahan tenaga kerja dari dan ke perusahaan lainnya atau berhentinya karyawan dari perusahaan yang mengupahnya dengan berbagai alasan. Apabila terjadi perselisian antara pihak pekerja dengan pengusaha maka penyelesaian seluruhnya telah diatur didalam Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian perselisihan hubungan industrial (UUPPHI). Salah satu kasus yang akan penulis kaji ialah terkait perselisihan pemutusan hubungan kerja pada putusan No.103/Pdt.Sus-PHI/2019/PNMdn yang mana pemutusan hubungan kerja tersebut berkaitan dengan hak-hak normatif yang seharusnya diterima oleh pihak yang di PHK. Adapun rumusan masalah dari penelitian tersebut adalah Apakah pembagian hak-hak normatif karyawan pada putusan No. 103/ Pdt.Sus-PHI/2019/PNMdn sesuai dengan ketentuan Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan dan bagaimana pertimbangan hukum hakim mengabulkan sebagian gugatan Penggugat terkait perselisihan hubungan industrial pada putusan No. 103/ Pdt.Sus-PHI/2019/PNMdn. Jenis penelitian hukum yang digunakan adalah hukum normatif yang bersifat deskriptif. Lokasi penelitian dilakukan di Pengadilan Negeri Medan. Data yang digunakan yaitu menggunakan data sekunder. Data tersebut dikumpulkan dengan metode studi pustaka. Data yang telah dikumpulkan dianalisa secara kualitatif. Berdasarkan hasil penelitain penulis ditemukan bahwa Bahwa penetapan pembagian hak-hak Normatif karyawan/buruh pada Putusan Perkara No. 103/ Pdt.Sus-PHI/2019/PNMdn sudah sesuai dengan ketentuan Undang-Undang No, 13 tahun 2003 tentang Ketenagakerjaan, yang mana putusan tersebut sudah memalui proses persidangan Perselisihan Hubungan Industrial di Pengadilan Negri Medan. Pertimbangan hukum hakim atas gugatan yang diajukan penggugat pada putusan No. 103/ Pdt.Sus-PHI/2019/PNMdn, Hakim memutuskan bahwa telah terjadi pemutusan hubungan kerja antara Penggugat dengan Tergugat tidak secara sepihak, namum berdasarkan fakta-fakta yang terjadi selama persidangan Penggugat sudah dianggap telah mengundurkan diri dari perusahaa yang mana bukti-bukti surat yang diajukan oleh Tergugat telah menunjukkan Surat Peringatan I, II, III, dan surat klarifikasi pelanggaran ketidak hadiran Penggugat untuk bekerja, Maka atas tindakan tersebut sesuai ketentuan Pasal 168 Undang undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan The causes of layoffs are caused by various factors, namely caused by employees and the company, and some are caused by things beyond the control of both parties. Termination of employment is defined as the permanent cessation of employment between the company and its employees, as a separation between the company and workers, the transfer of workers from and to other companies or the stopping of employees from companies that pay wages for various reasons. If there is a dispute between the employee and the entrepreneur, the full settlement has been regulated in Law No. 2 of 2004 concerning the settlement of industrial relations disputes (UU PPH). One of the cases that the writer will examine is related to a dispute over termination of employment in the decision No.103 / Pdt.Sus-PHI / 2019 / PN Mdn, where the termination of employment is related to the normative rights that should be received by the party laid off. The formulation of the problem of the study is whether the distribution of the normative rights of employees in the decision No. 103 / Pdt.Sus-PHI / 2019 /PN Mdn in accordance with the provisions of Law No. 13 of 2003 concerning Manpower and how the judges' legal considerations granted part of the Plaintiff's claim related to industrial relations disputes in Decision No. 103 / Pdt.Sus-PHI / 2019 / PN Mdn. This type of legal research used is descriptive normative law. The location of the research was conducted at the Medan District Court. The data used is using secondary data. The data were collected using literature study method. The data that has been collected were analyzed qualitatively. Based on the results of the author's research it was found that the determination of the distribution of the Normative rights of employees / laborers in the Decision of Case No. 103 / Pdt.Sus-PHI / 2019 / PN Mdn is in accordance with the provisions of Law No. 13 of 2003 concerning Manpower, where the decision has gone through the Industrial Relations Dispute trial at the Medan District Court. Judges' legal considerations on the lawsuit filed by the plaintiff in decision No. 103 / Pdt.Sus-PHI / 2019 / PN Mdn, the Judge decided that there had been a termination of employment between the Plaintiff and the Defendant not unilaterally, but based on the facts that occurred during the trial, the Plaintiff was deemed to have resigned from the company where the documentary evidence filed by the Defendant has shown a warning letter I, II, III, and a letter of clarification of the violation of the Plaintiff's absence to work, so the action is in accordance with the provisions of Article 168 of Law Number 13 of 2003 concerning Manpower. |
