dc.description.abstract | Pandemi Covid-19 secara nyata berdampak pada sektor ekonomi, khususnya kalangan perbankan dalam memperoleh pelunasan hutang dari debitur. Untuk memperoleh pelunasan hutang dari debitur wanprestasi dapat dilakukan dengan menjual jaminan hutang yang telah diikat Hak Tanggungan. Undang- Undang No 4 Tahun 1996 tentang Hak Tanggungan memberikan kekuasaan bagi kreditur pemegang Hak Tanggungan pertama untuk menjual objek Hak Tanggungan melalui pelelangan umum serta mengambil pelunasan dari hasil penjualan. Lelang eksekusi Hak Tanggungan dilaksanakan melalui perantara Pejabat Lelang pada Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL). Lahirnya Undang-undang No 11 Tahun 2008 tentang Informasi dan Transaksi Elektonik (ITE), perkembangan teknologi, serta terjadinya pandemi Covid-19 yang membatasi pertemuan secara fisik, menjadikan lelang dapat dilakukan melalui media internet dan dokumen elektronik yang dihasilkan merupakan alat bukti yang sah menurut hukum. Lelang melalui media internet dapat menjadi terobosan dari sistem lelang secara konvensional. Rumusan masalah dalam penelitian ini adalah bagaimana aturan hukum dan mekanisme pelaksanaan lelang eksekusi Hak Tanggungan melalui media internet ketika Pejabat Penjual dan peserta lelang tidak hadir secara fisik dalam proses lelang dan hambatan dalam pelaksanaan lelang melalui internet. Penelitian ini bertujuan untuk mengkaji dan menganalisis aturan hukum, mekanisme dan hambatan yang dihadapi dalam pelaksanaan lelang eksekusi Hak Tanggungan melalui media internet masa pandemi Covid-19 berdasarkan undang-undang ITE. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif. Hasil penelitian menunjukkan pelaksanaan lelang eksekusi Hak Tanggungan melalui media internet masa pandemi Covid-19 berdasarkan undang-undang ITE pada KPKNL Medan telah dilaksanakan berdasarkan hukum yang berlaku dan Risalah lelang yang dihasilkan merupakan akte otentik yang sah. Perlu diupayakan perbaikan baik dari segi peraturan maupun sistem pendukungnya agar pelaksanaan lelang melalui internet dapat dilaksanakan secara efektif, transparan, akuntabel, adil, dan menjamin kepastian hukum. The Covid-19 pandemic had an impact on the economic sector, especiallysector the bankingin obtaining debt repayment from debtors. To get a debt repayment from a default debtor, it can be done by selling the debt collateral that has been tied to a Mortgage. Law No. 4 of 1996 concerning Mortgage Rights gives power to creditors who hold the first Mortgage to sell the object of the Mortgage through a public auction and collect the repayment of the proceeds from the sale. The auction for the execution of the Mortgage is carried out through an intermediary by the Auction Officer at the State Property and Auction Service Office (KPKNL). The birth of Law No.11 of 2008 concerning Information and Electronic Transactions (ITE), technological developments, as well as the Covid-19 pandemic which limited physical meetings, made the auction can be carried out through the internet media and the resulting electronic documents are valid evidence according to law. Internet auction can be a breakthrough from the conventional auction system. The formulation of the problem in this research is how the legal rules and implementation mechanisms for the execution of the mortgage execution auction through the internet media when the selling officials and auction participants are not physically present in the auction process and the obstacles in the auction through the internet This study aims to examine and analyze the legal rules, mechanisms and obstacles faced in the implementation of the auction execution of Mortgage Rights through the internet media during the Covid-19 pandemic based on the ITE law. This type of research is normative juridical law research. The results show that the implementation of the auction execution of Mortgage Rights through the internet media during the Covid-19 pandemic based on the ITE law at the Medan KPKNL has been carried out based on the applicable law and the resulting auction minutes are valid authentic deeds. Efforts still need to be made in terms of both the regulations and the supporting system so that the auction through the internet can be carried out in an effective, transparent, accountable, fair manner and guarantees legal certainty. | en_US |
