Politik Hukum Pemberantasan Tindak Piidana Narkotika Dimasa Pandemi Covid-19 (Studi Kepolisian Daerah Sumatera Utara)

Abstract

Di masa Pandemi Covid 19, penegakan hukum terhadap tindak pidana narkotika tetap dilaksanakan oleh Kepolisian sebagai bagian dari institusi penegak hukum. Modus dan strategi dari para Bandar/Penggedar narkoba terus berkembang dengan cara-cara baru dan media baru sehingga para aparatur penegak hukum tidak dapat mendeteksi peredaran narkoba yang dilakukan. Penyalahgunaan narkoba di saat pandemi covid-19 memberikan dampak buruk bagi stabilitas sosial, ekonomi, politik dan keamanan nasional. Sumatera Utara saat ini menjadi daerah tertinggi penyebaran peredaran gelap narkoba, hal ini menandakan bahwa penegakan hukum terhadap tindak pidana narkotika belum maksimal dilakukan. Permasalahan dalam penelitian ini yakni bagaimana modus operandi kejahatan peredaran dan penyalahgunaan narkotika pada masa pandemi Covid-19?. Bagaimana peran Kepolisian Daerah Sumatera Utara dalam memberantas peredaran narkotika pada masa pandemi Covid-19 di Sumatera Utara?. Bagaimana Politik Hukum Kepolisian Republik Indonesia di masa depan dalam menangani pemberantasan peredaran narkotika?. Metode penelitian yang digunakan adalah yuridis normatif. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Analisis data kualitatif dipergunakan dalam menganalisis permasalahan. Hasil penelitian menemukan bahwa pertama, Modus operandi kejahatan peredaran dan penyalahgunaan narkotika pada masa pandemi Covid 19 telah berkembang yaitu dengan pengiriman tiga botol narkotika berupa cairan dari China berisi 10 ml yang bertuliskan Hemp Oil, Penyalahgunaan narkoba dilakukan di rumah, apartemen, maupun hotel sifatnya home session, Modus operandi menggunakan jasa pos dan ekspedisi kebeberapa daerah, dan melalui Online dengan website, selain itu modus peredaran dengan transportasi logistik pertanian, seolah-oleh mengirimkan barang untuk kebutuhan masyarakat. Hasil yang kedua, bahwa Peran Kepolisian Daerah Sumatera Utara dalam memberantas peredaran narkotika pada masa pandemi Covid- 19 di Sumatera Utara melaksanakan 4 langkah strategis diantaranya observasi (pengamatan), surveilance (pembuntutan), undercover buy (pembelian terselubung), controlled delevery (penyerahan yang diawasi). Ketiga, bahwa Politik Hukum Kepolisian Republik Indonesia di masa depan menangani pemberantasan peredaran narkotika adalah melakukan upaya konsolidasi dengan Pemerintah untuk perubahan UU No. 35 tahun 2009, Perbaikan struktur internal Polri. North Sumatra is currently the highest area for the spread of illicit drug trafficking, this indicates that law enforcement against narcotics crimes has not been maximally carried out. The problem in this research is what is the modus operandi of drug trafficking and drug abuse during the Covid-19 pandemic ?; what is the role of the North Sumatra Regional Police in eradicating the circulation of narcotics during the Covid-19 pandemic in North Sumatra ?; What is the future criminal policy of the Indonesian National Police in dealing with the eradication of narcotics trafficking?. The research method used is normative juridical. The data used are secondary data consisting of primary, secondary and tertiary legal materials. Qualitative data analysis is used in analyzing the problem. The results of the study found that first, the modus operandi of trafficking crimes and narcotics abuse during the Covid 19 pandemic had developed, namely by sending three bottles of narcotics in the form of a 10 ml liquid from China that reads Hemp Oil, Drug abuse is carried out in homes, apartments, and home hotels. session, the modus operandi uses postal and expedition services to several regions, and via online with the website, besides that the mode of circulation is by means of agricultural logistics transportation, as if sending goods for the needs of the community.
