Abstract: | Penyebaran narkotika yang sudah meluas hingga ke berbagai lapisan masyarakat dan kepelosok desa telah sampai menjangkau anak-anak yang kemampuan berpikirnya masih rendah. Dalam putusan majelis hakim tidak menerapkan diversi yang mengacu pada Pasal 12, Pasal 52 ayat (5) Undang- Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Berdasarkan hal tersebut rumusan masalah dalam penelitian ini: 1) Bagaimana pengaturan perlindungan hukum terhadap anak penyalahguna narkotik, 2) Bagaimana proses perlindungan hukum terhadap anak sebagai penyalahguna narkotika di Pengadilan Negeri Medan, 3) Bagaimana pertimbangan hakim dalam perlindungan hukum terhadap anak sebagai penyalahguna narkotika berdasarkan putusan Nomor 44/Pid.Sus- Anak/2019/PN.Mdn. Adapun metode penelitian yang digunakan adalah metode deskriptif, sedangkan teknik analisis data menggunakan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum yang dilakukan terhadap anak sebagai penyalahguna narkotika di Indonesia berdasarkan Undang-Undang No 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak telah diatur mulai dari proses penyidikan, penangkapan, penahanan, penuntutan, pemeriksaan di pengadilan dan pemasyarakatan. Pengadilan Negeri Medan telah berupaya melakukan proses perlindungan hukum terhadap anak sebagai penyalahguna narkotika dengan berpedoman pada UU No 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Hakim Anak berupaya mewujudkan proses perlindungan hukum dengan memenuhi hak-hak anak selama proses pemeriksaan, serta mengupayakan penyelesaian perkara melalui diversi. Tetapi upaya hakim anak dalam proses perlindungan hukum anak masih belum maksimum. Pertimbangan hakim anak dalam perkara No. 44/Pid.Sus-Anak/2019/PN Mdn, telah gagal memberikan perlindungan hukum kepada Anak penyalahguna narkotika, karena anak dipidana dengan penjara 1 tahun. Disarankan dalam memberikan perlindungan maksimum terhadap Anak, pemerintah perlu mempertimbangkan untuk merevisi UU SPPA dengan menghilangkan pembatasan diversi sebagaimana diatur pada pasal 7 ayat (2) yaitu diancam dengan pidana penjara di bawah 7 (tujuh) tahun dan bukan merupakan pengulangan tindak pidana, sehingga undang-undang tersebut benar-benar dapat memberikan perlindungan yang lebih baik terhadap semua anak pada semua tindak pidana. Hakim yang menangani perkara anak penyalahguna narkotika perlu memberi putusan yang lebih mempertimbangkan kepentingan perlindungan hukum terhadap anak, yaitu dengan mengutamakan proses pemulihan terhadap kecanduan anak melalui lembaga rehabilitasi, serta menghindari pemidanaan kepada anak. Pemerintah perlu mempertimbangkan untuk sepenuhnya menanggung biaya rehabilitasi anak penyalahguna narkotika dengan standar biaya yang lebih layak, sehingga setiap anak penyalahguna narkotika dapat menjalani pemulihan di lembaga rehabilitasi. The spread of narcotics which has spread to various levels of society and remote villages has reached children whose thinking abilities are still low. In the decision of the panel of judges not to apply diversion which refers to Article 12, Article 52 paragraph (5) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. Based on this, the formulation of the problem in this study: 1) How are the legal protection arrangements for children who abuse narcotics, 2) How is the legal protection process for children as narcotics abusers in the Medan District Court, 3) How are judges' considerations in legal protection of children as narcotics abusers based on decision Number 44/Pid.Sus- Anak/2019/PN.Mdn. The research method used is descriptive method, while the data analysis technique uses descriptive qualitative. The results of the study indicate that the legal protection carried out against children as narcotics abusers in Indonesia based on Law No. 11 of 2012 concerning the Juvenile Criminal Justice System has been regulated starting from the process of investigation, arrest, detention, prosecution, examination in court and correctional. The Medan District Court has tried to carry out the legal protection process for children as narcotics abusers by referring to Law No. 11 of 2012 concerning the Juvenile Criminal Justice System. Juvenile Judges seek to realize the legal protection process by fulfilling children's rights during the examination process, as well as seeking settlement of cases through diversion. However, the efforts of juvenile judges in the legal protection process for children are still not maximal. The consideration of the juvenile judge in case no. 44/Pid.Sus-Anak/2019/PN Mdn, has failed to provide legal protection to children who abuse narcotics, because children are sentenced to 1 year in prison. It is recommended that in providing maximum protection for children, the government needs to consider revising the SPPA Law by removing the diversion restriction as regulated in article 7 paragraph (2), which is threatened with imprisonment for under 7 (seven) years and is not a repetition of a crime, so that the law the law can really provide better protection for all children in all crimes. Judges who handle cases of child drug abusers need to give a decision that takes into account the interests of legal protection for children, namely by prioritizing the recovery process for children's addictions through rehabilitation institutions, as well as avoiding punishment for children. The government needs to consider fully covering the costs of rehabilitating children who use narcotics at a more reasonable standard, so that every child who abuses narcotics can undergo recovery in a rehabilitation institution. |
