Peran Kepolisian Dalam Upaya Penegakan Hukum Atas Tindak Pidana Hak Cipta Lagu Dan/Atau Musik Dengan Atau Tanpa Teks Di Kota Medan

Abstract

Hak cipta lagu dan/atau musik dengan atau tanpa teks merupakan hasil intelektualitas manusia diberi perlindungan hukum yang dilindungi negara. Polisi sebagai salah satu alat negara memiliki peranan penting dalam menjamin penegakan hukum, sementara di sisi lain pelanggaran hak cipta lagu dan/atau musik dengan atau tanpa teks masif terjadi. Permasalahan dalam penelitian ini, yaitu: 1. Pengaturan hukum terkait peran kepolisian dalam penegakan hukum hak cipta lagu dan/atau musik dengan atau tanpa teks? 2. Kepolisian Resor Kota Besar Medan dalam menjalankan perannya sebagai penegakan hukum atas tindak pidana hak cipta lagu dan/atau musik dengan atau tanpa teks; dan 3. faktor-faktor yang mempengaruhi penegakan hukum atas tindak pidana hak cipta lagu dan/atau musik dengan atau tanpa teks di kota Medan. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris, guna mendapat ketentuan hukum normatif dan penerapannya pada setiap peristiwa hukum tertentu. Hasil penelitian menujukkan beberapa hal: 1. Peran kepolisian dalam penegakan hukum hak cipta lagu dan/atau musik dengan atau tanpa teks diatur dalam UU No. 2 tahun 2002, meliputi: peran pre-emtif, preventif dan represif; 2. Kepolisian Resor Kota Besar Medan dalam menjalankan perannya sebagai penegak hukum atas tindak pidana hak cipta lagu dan/atau musik dengan atau tanpa teks tidak maksimal; dan 3. Faktor-faktor yang mempengaruhi penegakan hukum atas tindak pidana hak cipta lagu dan/atau musik dengan atau tanpa teks di kota medan, yaitu: faktor perundang-undangan, dalam masalah delik aduan; faktor penegak hukum, dalam masalah kapasitas anggota; faktor Sarana dan prasarana yang kurang mendukung; faktor kesadaran hukum, dalam masalah minimnya penyuluhan hukum; dan faktor kebudayaan, terkait adanya perbedaan norma dalam hukum hak cipta antara yang ada dalam masyarakat dan regulasi. Untuk itu, disarankan: 1. Mengembalikan delik delik biasa dalam regulasi; 2. Melakukan pengawasan, bekerja sama dan berkoordinasi dengan setiap pemangku kepentigan; 3. Melakukan penyuluhan hukum guna mewujudkan kesadaran hukum masyarakat yang lebih baik. The police as one of the state's instruments have an important role in ensuring law enforcement, while on the other hand, violations of copyright for songs and/or music with or without text occured massively. The problems in this research are: 1. Legal arrangements related to the role of the police in enforcing copyright law for songs and/or music with or without text 2. The Metropolitan Police of Medan City in carrying out its role as law enforcement against the criminal act of copyright songs and/or music with or without text; and 3. factors that influence law enforcement on the criminal act of copyright songs and/or music with or without text in Medan. The research method used is normative-empirical legal research, in order to obtain normative legal provisions and their application to any particular legal event. The results of this research show several things: 1. The role of the police in enforcing copyright laws for songs and/or music with or without text is regulated in Law no. 2 of 2002, covering: pre-emtive, preventive and repressive roles; 2. The Metropolitan Police of Medan City, in carrying out their role as law enforcer for the crime of copyright songs and/or music with or without text is not optimal; and 3. Factors affecting law enforcement on the criminal act of copyright songs and/or music with or without text in the city of Medan, namely: statutory factors, in the matter of crime by accusation; law enforcer factors, in terms of the capacity of members; less supportive factors of infrastructure and facilities; legal awareness factor, in the problem of the lack of legal counseling; and cultural factors, related to the differences in norms in copyright law between those in society and regulations. For this reason, it is recommended that: 1. Return the usual offense in the regulations; 2. Supervise, cooperate and coordinate with each stakeholder; 3. Conducting legal education in order to create a better legal awareness of the community.
