dc.description.abstractAksi unjuk rasa yang berakhir dengan anarkis sering terjadi di wilayah Provinsi Sumatera Utara. Aksi yang berujung bentrok tersebut dibubarkan kepolisian setelah adanya lemparan batu dari arah pendemo. Berdasarkan hal tersebut rumusan masalah dalam penelitian ini: 1) Bagaimana aturan hukum tentang kemerdekaan menyampaikan pendapat di muka umum, 2) Faktor-faktor apa saja yang menyebabkan aksi unjuk rasa anarkis, 3) Bagaimana dasar pertimbangan hakim dalam memutus perkara unjuk rasa anarkis di Tarutung sebagaimana dinyatakan dalam Putusan No. 168/Pid.B/2018/PN.Trt. Adapun metode penelitian yang digunakan adalah metode deskriptif, sedangkan teknik analisis data menggunakan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa aturan hukum pelaksanaan unjuk rasa di atur dalam UU No. 9 Tahun 1998 Tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum. Pada pasal 6 dinyatakan bahwa warga negara yang menyampaikan pendapat di muka umum berkewajiban dan bertanggungjawab untuk: menghormati hak-hak orang lain, menghormati aturan-aturan moral yang diakui umum, menaati hukum dan ketentuan peraturan perundang-undangan yang berlaku, menjaga dan menghormati keamanan dan ketertiban umum, dan menjaga keutuhan persatuan dankesatuan bangsa. Kemudian Perkapolri No. 7 tahun 2012 juga menyatakan bahwa pernyataan pendapat dimuka umum dilarang menghasut supaya melakukan perbuatan pidana atau kekerasan terhadap penguasa umum serta dilarang menentang penguasa umum dengan kekerasan. Adapun faktor-faktor yang menyebabkan terjadinya aksi unjuk rasa anarkis adalah: kekecewaan massa atas tuntutan demo, kurangnya antisipasi aparat keamanan, tindakan represif aparat keamanan, adanya provokator, faktor psikologis massa yang mudah meledak, penggunaan alkohol dan obat terlarang, keinginan orang-orang tertentu di dalam massa untuk disebut pahlawan, keterlibatan orang-orang yang tidak memahami aturan pelaksanaan demonstrasi, keterlibatan orang-orang yang hanya sekedar ikut-ikutan dan tidak mengerti tuntutan demonstrasi, keterlibatan anak di bawah umur, adanya orang-orang yang membawa senjata tajam, kurangnya antisipasi penanggungjawab demo, pengamanan yang lemah, dan jumlah massa yang terlalu banyak. Dasar pertimbangan hakim dalam perkara No. 168/Pid.B/2018/PN.Trt menyatakan terdakwa bersalah melakukan tindak pidana sebagaimana diatur dalam pasal 170 ayat (2) ke-1 KUHP sudah tepat, karena terdakwa telah melakukan kekerasan terhadap barang berasama-sama dengan massa pengunjuk rasa, yang dilakukan dengan sengaja dan mengakibatkan gedung kantor Panwaslih tidak dapat dipakai lagi karena hancur. Tetapi pidana yang dijatuhkan kepada terdakwa terlalu ringan, yaitu 7 bulan penjara. Pidana tersebut kurang memberi efek penjeraan kepada terdakwa dan orang lain yang ingin melakukan tindak pidana yang sama. Disarankan masyarakat yang hendak menyampaikan aspirasi dengan melakukan unjuk rasa perlu mematuhi aturan hukum yang berlaku, agar menghindari tindakan anarkis serta berupaya mencegah orang lain untuk bertindak anarkis selama pelaksanaan unjuk rasa. Kepada instansi yang menjadi tujuan pengunjuk rasa disarankan agar berupaya dengan segera mengajak massa pengunjuk rasa untuk duduk bersama membicarakan tuntutan yang diajukan, sehingga dengan segera dapat menyenangkan emosi massa. Majelis hakim yang mengadili perkara unjuk rasa dengan kekerasan (anaskis) disarankan agar lebih tegas dalam menjatuhkan pidana, agar pidana yang dijatuhkan tidak terlalu ringan, sehingga dapat memberi efek penjeraan bagi terdakwa dan bagi pihak lain yang hendak melakukan kekerasan dalam unjuk rasa. Demonstrations that end in anarchism often occur in the province of North Sumatra. The police dismissed the action which ended in clashes after a stone was thrown at the demonstrators. Based on this, the formulation of the problems in this study are: 1) How are the legal rules regarding freedom of expression in public, 2) What factors cause anarchist demonstrations, 3) What are the basic considerations for judges in deciding cases of anarchist demonstrations in Tarutung as stated in Decision No. 168 / Pid.B / 2018 / PN.Trt. The research method used is descriptive method, while the data analysis technique used is descriptive qualitative. The results showed that the legal rules for implementing demonstrations are regulated in Law no. 9 of 1998 concerning Freedom to Express Opinions in Public. Article 6 states that citizens who express their opinions in public have the obligation and responsibility to: respect the rights of others, respect generally recognized moral rules, obey the laws and provisions of applicable laws and regulations, maintain and respect security and public order, and maintaining the integrity of the nation. Then Perkapolri No. 7 of 2012 also states that public opinion statements are prohibited from inciting criminal acts or violence against the general authorities and are prohibited from opposing the general authorities by force. The factors that led to anarchist demonstrations were: mass disappointment with the demands of the demonstration, lack of anticipation by the security forces, repressive actions by the security forces, the presence of provocateurs, explosive mass psychological factors, use of alcohol and illegal drugs, the desire of certain people. in the masses to be called heroes, the involvement of people who do not understand the rules for carrying out demonstrations, the involvement of people who just join in and do not understand the demands of the demonstration, the involvement of minors, the presence of people carrying sharp weapons, the lack of anticipation of the person in charge of the demonstration, weak security, and too many masses. The basis for the judge's consideration in case No. 168 / Pid.B / 2018 / PN.Trt found the defendant guilty of committing a criminal act as stipulated in Article 170 paragraph (2) 1 of the Criminal Code was correct, because the defendant had committed violence against property together with the mass of protesters, which was committed intentionally and resulted in the Panwaslih office building being unusable because it was destroyed. However, the sentence imposed on the defendant was too light, namely 7 months in prison. The crime did not have a deterrent effect on the defendant and other people who wanted to commit the same crime. It is recommended that people who wish to convey their aspirations by conducting demonstrations need to comply with the applicable legal rules, in order to avoid anarchist actions and to try to prevent others from acting anarchically during the demonstration. It is advisable to the agencies that are the protesters' destination to immediately try to get the mass of protesters to sit together to discuss the demands put forward, so that they can immediately please the emotions of the masses. The panel of judges adjudicating cases of violent demonstrations (anaskis) is advised to be more assertive in imposing crimes, so that the sentences imposed are not too light, so that they can have a deterrent effect on the accused and for other parties who wish to commit violence in demonstrations.en_US
