Peranan Kepolisian Resor Tebing Tinggi Dalam Penegakan Hukum Terhadap Tindak Pidana Ujaran Kebencian Berkaitan Dengan Suku, Agama, Ras Dan BAntar Golongan Di Media Sosial

Abstract

Latar belakang Kehadiran teknologi informasi yang demikian canggih telah memberikan nuansa baru dengan menyentuh hampir semua aspek kehidupan. Teknologi telah memberi kemudahan bagi masyarakat untuk melakukan aktivitas sehari-hari dalam memenuhi kebutuhannya, serta memudahkan interaksi antar sesama manusia di mana pun berada.Rumusan masalah dalam penelitian ini: 1) Bagaimana aturan hukum mengenai tindak pidana ujaran kebencian di media sosial, 2) Bagaimana peranan Kepolisian Resor Tebing Tinggi dalam penegakan hukum terhadap tindak pidana ujaran kebencian di media sosial, 3) Bagaimana kendala yang dihadapi Kepolisian Resor Tebing Tinggi dalam penegakan hukum terhadap tindak pidana ujaran kebencian di media sosial. Metode penelitian yang digunakan adalah metode deskriptif, sedangkan teknik analisis data menggunakan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa aturan hukum tentang tindak pidana ujaran kebencian diatur dalam Surat Edaran Kapolri Nomor SE/06/X/2015 tentang Ujaran Kebencian dan Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik. Dari kasus tindak pidana ujaran kebencian yang terjadi selama 3 tahun terakhir proses hukumnya diselesaikan secara berdamai maupun vonis oleh majelis hakim Pengadilan Negeri Tebing Tinggi. Kesimpulan dari penelitian ini yaitu Peranan Kepolisian Resor Tebing Tinggi dalam penanggulangan tindak pidana ujaran kebencian diatur dalam kitab undang – undang hukum acara pidana (KUHAP) yakni polisi sebagai penyidik dan penyelidik dari suatu tindak pidana. Saran dari tesis ini yaitu Kepolisian Resor Tebing Tinggi perlu melakukan sosialisasi peraturan perundang – undangan kepada masyarakat, agar masyarakat dapat mengenal hukum bagi pelaku tindak pidana ujaran kebencian dan masyarakat dapat mematuhi aturan tersebut. Based on this, the formulation of the problems in this study are: 1) What are the legal rules regarding the crime of hate speech on social media 2) What is the role of the Tebing Tinggi Police in law enforcement against hate speech crimes on social media 3) What are the obstacles faced by the Tebing Tinggi Police in law enforcement against hate speech crimes on social media. The research method used is descriptive method, while the data analysis technique used is descriptive qualitative. The results show that the legal rules regarding hate speech are regulated in the Chief of Police Circular Letter Number SE / 06 / X / 2015 concerning Hate Speech and the Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Information. Electronic Transactions. Law enforcement against hate speech crimes refers to the theory of law enforcement according to Soerjono Soekanto that law enforcement has 5 elements, namely: first, legal substance, second; Law enforcement, third, facilities and infrastructure, fourth, society, and fifth, culture. The conclusion of this study is the role of the Tebing Tinggi Police in handling hate speech crimes is regulated in the Criminal Procedure Code (KUHAP), namely the police as investigators and investigators of a crime. The suggestion from this thesis is that the Tebing Tinggi Police Department needs to disseminate the laws and regulations to the public, so that people can get to know the law for hate speech offenders and the public can comply with these rules.
