dc.description.abstract | Adapun yang menjadi landasan utama dalam pelaksanaan kegiatan di Dinas Lingkungan Hidup Provinsi Sumatera Utara adalah konsep pembangunan berkelanjutan yang berwawasan lingkungan, yang mengandung makna bahwa setiap orang memiliki kewajiban dan tanggungjawab dalam pemeliharaan dan kelestarian lingkungan hidup, baik untuk saat sekarang ini dan kelangsungannya dimasa yang akan datang. Dinas Lingkungan Hidup Provinsi Sumatera Utara memiliki peran dalam penegakan hukum lingkungan dengan melakukan tindakan administrasi kepada setiap orang yang melanggar baku mutu air limbah, baku mutu gangguan, dan baku mutu emisi. Tindakan administrasi ini merupakan bagian dalam penegakan hukum pidana di bidang lingkungan yang memperhatikan asas ultimum remedium. Penerapan asas Ultimum Remedium terdapat pada pasal 100 Undang-Undang Nomor 32 Tahun 2009 Tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Penerapan asas ultimum remedium ini hanya berlaku bagi tindak pidana formil tertentu, yaitu pemidanaan terhadap pelanggaran baku mutu air limbah, emisi, dan gangguan. As for the main basis for the implementation of activities at the Environmental Service of North Sumatra Province is the concept of environmentally sustainable development, which implies that everyone has an obligation and responsibility for environmental preservation and preservation, both for now and its sustainability in the future come. The Environmental Service of North Sumatra Province has a role in enforcing environmental laws by taking administrative action against anyone who violates the quality standard for wastewater, disturbance quality standards and emission quality standards. This administrative action is part of criminal law enforcement in the environmental sector that takes into account the ultimum remedium principle.The application of the Ultimum Remedium principle is contained in Article 100 of Law Number 32 Year 2009 concerning Environmental Protection and Management.
