Penyelesaian Sengketa Dengan Mediasi Antara Pt. Able Commodities Indonesia Dengan Warga Sekitar Dalam Hal Pelaksanaan Corporate Social Responsibility (Csr) (Studi Di Koramil 10/Medan Labuhan Berdasarkan Nota Kesepahaman No. 001/Nk/Viii/2017)

Abstract

Mediasi non litigasi adalah cara penyelesaian sengketa diluar peradilan. Pihak ketiga yang netral dan berfungsi sebagai penengah atau memfasilitasi mediasi tersebut yang biasa disebut mediator.Pihak ketiga tersebut hanya boleh memberikan saran-saran yang bersifat sugestif. Dalam penelitian ini penulis mengambil putusan Nota Kesepahaman Nomor 001/NKVIII/2017 sebagai bahan kajian, berdasarkan hal tersebut pada penelitian awal penulis menemukan bhawa konflik yang terjadi antara warga sekitar perusahaan dengan perusahaan PT Able Commudities Indonesia terkait dengan masalah Corporate Social Responsibility (CSR). Dari uraian tersebut maka masalah yang penulis temukan adalah mengenai Proses mediasi yang dilakukan oleh pihak PT ACI dengan masyarakat lingkungan perusahaan, bentuk kesepakatan yang dibuat oleh pihak PT ACI dengan masyarakat lingkungan perusahaan, akibat hukum dari mediasi antara PT ACI dengan Masyarakat lingkungan perusahaan. Metode penelitian yaitu penelitian jenis yuridis normative yaitu bagaimana penerapan hukum posisf yang terkait dengan permasalahan yang diteliti, teknik pengumpulan data yaitu, penelitian kepustakaan dan wawancara dengan pihak-puhak yang terkait dengan permasalaha yang diteliti. Berdasarkan penelitian yang telah dilakukan, penulis menarik kesimpulan bahwa Proses Proses mediasi yang dilakukan oleh pihak PT. ACI dengan masyarakat lingkungan perusahaan Pihak perusahaan PT ACI melaporkan perihal adanya konflik antara warga dengan perusahaan (PT ACI) ke Koramil 10/Medan Labuhan, PT ACI meminta kepada Koramil 10/Medan Labuhan sebaga mediator dengan warga setempat dilingkungan perusahaan untuk dilakukan mediasi, Pihak Koramil kemudian mengundang/menghadirkan beberapa tokoh masyarakat dan unsur pemerintahan setempat, Kapolsek Medan Labuhan, Camat Medan Labuhan, Kepala Lingkungan (Kepling), Pertemuan para pihak dilaksanakan di Kantor Koramil 10/Medan Labuhan, Bentuk kesepakatan yang di buat oleh pihak PT. ACI dengan Masyarakat lingkungan perusahaan PT. ACI sebagai pihak pertama bersedia menerima penduduka setempat yang memiliki potensi untuk bekerja di lingkungan PT. Able Commodities Indonesia (ACI), masyarakat akan membuka kases ke perusahaan dan membuka permanen portal yang menutp akses ke perusahaan, Akibat hukum dari mediasi antara PT. ACI dengan masyarakat lingkungan perusahaan apabila mediasi yang telah berhasil dilakukanmaka para pihak tersebut dengan dibantu mediator untuk membuat suatu kesepakatan atau suatu perjanjian perdamaian. Non-litigation mediation is a way of resolving disputes outside the court. A third party who is neutral and functions as a mediator or facilitates the mediation, which is usually called a mediator. The third party may only provide suggestions that are suggestive. In this study the authors took the decision of the Memorandum of Understanding Number 001 / NKVIII / 2017 as a study material, based on this, in the initial research the author found that the conflict that occurred between residents around the company and the company PT Able Commudities Indonesia was related to the problem of Corporate Social Responsibility (CSR). From this description, the problem that the authors found is regarding the mediation process carried out by PT ACI with the company's environmental community, the form of an agreement made by PT ACI with the company's environmental community, the legal consequences of mediation between PT ACI and the company's environmental community. The research method is normative juridical research, namely how to apply positive law related to the problems studied, data collection techniques, namely, library research and interviews with parties related to the problems studied. Based on the research that has been done, the authors draw the conclusion that the mediation process carried out by the PT. ACI and the company community, PT ACI, reported a conflict between residents and the company (PT ACI) to Koramil 10/Medan Labuhan, PT ACI asked Koramil 10/Medan Labuhan as a mediator with local residents within the company to conduct mediation, The Koramil then invited/presented several community leaders and elements of local government, the Head of the Medan Labuhan Police, the Head of the Medan Labuhan District, the Head of the Environment (Kepling). The meeting of the parties was held at the Medan Labuhan Koramil Office, The form of an agreement made by the PT. ACI with PT. ACI as the first party is willing to accept local penduduka who have the potential to work in the PT. Able Commodities Indonesia (ACI), the public will open access to the company and permanently open a portal that closes access to the company. Due to the legal consequences of the mediation between PT. ACI with the company environment community if the mediation has been successfully carried out, the parties, assisted by a mediator, to make an agreement or a peace agreement.
