Abstract: Advokat adalah satu - satunya unsur Pembela sekaligus Penegak Hukum yang bersifat Independen dan Mandiri dalam sistim hukum Indonesia. Banyaknya advokat yang tertangkap tangan menyuap, bermain dua kaki, memberikan harapan dan janji berlebihan menjadi faktor terjadinya pergeseran paradigma dari posisi advokat sebagai profesi yang officium nobile ke komersialisasi dan materialisasi yang menyebabkan perubahan perilaku advokat dalam pemberian jasa hukum dengan mengutamakan mereka yang mampu untuk membayar. Dan ini berimbas pada integritas moral dalam penegakan hukum. Hal ini terkait juga dengan totalitas advokat dalam profesinya dengan tiadanya pendapatan lain selain pemberian honorarium dari klien. Dalam praktek penerapan pemberian jasa hukum Advokat, tindakan pemegang peran/kuasa ini harus dapat mengontrol keputusan sendiri dan itu memerlukan kemampuan intelektual dan analisis antara hukum dengan lingkungan sosial, moral/etika serta tujuan luhur pemegang peran/kuasa. Kekuasaan atau power berarti suatu kemampuan untuk mempengaruhi orang atau merubah orang atau situasi. Atas dasar tersebut, advokat seharusnya setiap saat mempunyai kepedulian dan kemampuan (duty of care and skill), itikad baik, loyalitas, dan kejujuran terhadap kliennya dengan derajat yang tinggi (high degree) dan tidak terbagi. Wajib bagi setiap advokat untuk mengutamakan kepentingan kliennya melebihi dari kepentingan lain apa pun, termasuk melebihi kepentingan advokat itu sendiri. Dan karena itu, seharusnya Undang - undang Nomor 18 Tahun 2013 Tentang Advokat wajib mengatur tentang Standardisasi Kualifikasi Advokat dalam pemberian jasa hukum advokat yang menjamin bahwa advokat yang bersangkutan telah memiliki Problem Solving Skills, Dispute Resolution Skills, Counseling Skills, Convincing Skills, Competence Skills, Kemampuan untuk Bernegosiasi dan berpengalaman (experience) serta (knowledge) pengetahuan/disiplin ilmu yang sesuai serta (responbility) bertanggung jawab, tidak akan melakukan kebohongan, penyimpangan, kesalahan atau kelalaian yang merugikan para pencari keadilan, melukai rasa keadilan masyarakat, mengingkari kebenaran hukum atau membohongi hati nurani sendiri, dan tidak melanggar ketentuan peraturan Perundang - undangan yang mengatur tugas profesinya, serta (accountability) pekerjaan tersebut dapat dipertanggung jawabkan. Advocates are the only independent and independent element of defense and law enforcement in the Indonesian legal system. Many advocates caught bribing, playing with two legs, giving excessive hopes and promises are a factor in the paradigm shift from being an advocate as an official profession to commercialization and materialization which causes changes in the behavior of advocates in providing legal services by prioritizing those who can afford to pay. . And this has an impact on moral integrity in law enforcement. This is also related to the totality of advocates in their profession with no other income apart from providing honoraria from clients. In the practice of providing Advocate legal services, the actions of the holder of the role / power must be able to control their own decisions and that requires intellectual ability and analysis between law and the social, moral / ethical environment and the noble goals of the holder of the role / power. Power means the ability to influence people or change people or situations. On this basis, advocates should at all times have concern and ability (duty of care and skill), good faith, loyalty, and honesty towards their clients with a high degree (high degree) and not divided. It is obligatory for every lawyer to prioritize the interests of his client above any other interest, including over the interests of the lawyer himself. And because of that, Law Number 18 of 2013 concerning Advocates must regulate the Standardization of Advocate Qualifications in providing advocate legal services which ensures that the advocate concerned has Problem Solving Skills, Dispute Resolution Skills, Counseling Skills, Convincing Skills, Competence Skills, The ability to negotiate and have experience (experience) as well as (knowledge) of appropriate knowledge / disciplines and (responsibility) to be responsible, will not commit lies, deviations, mistakes or omissions that harm justice seekers, hurt people's sense of justice, deny legal truth or deceive one's own conscience, and does not violate the provisions of the laws and regulations governing his professional duties, as well as (accountability) the work can be accounted for.
