Tinjauan Yuridis Terhadap Prostitusi oleh Seorang Broker (Studi di Kepolisian Resor Kota Besar Medan)

Abstract

Masalah prostitusi adalah masalah struktural, Prostitusi juga merupakan permasalahan yang sangat kompleks karena menyangkut berbagai aspek kehidupan masyarakat, menurut penulis ada keunikan di dalam praktek prostitusi ini dimana unsur-unsur yang terlibat di dalamnya seperti pekerja seks komersial (PSK), Mucikari/ germo (broker) dan penyedia tempat di dalam hukum pidana yang menjadi tersangka adalah mucikari dan penyedia tempat saja. PSK adalah korban, prostitusi sebagaimana diatur dalam KUHP Pasal 296 dan Pasal 506 mengatur secara khusus tentang penyedia tempat atau yang memfasilitasi (Pasal 296) mucikari (Pasal 506). Adapun permasalahan yang ditemukan dalam penelitian ini adalah penerapan hukum terhadap prostitusi oleh seorang broker, bentuk penanggulangan terhadap prostitusi oleh seorang broker. Tujuan penelitian, untuk mengetahui penerapan hukum terhadap prostitusi oleh seorang broker, untuk mengetahui bentuk penanggulangan terhadap prostitusi oleh seorang broker, metode penelitian yaitu penelitian yuridis normatif, Teknik pengumpulan data yaitu dengan penelitian kepustakaan dan wawancara dengan pihak kepolisian di Polres Kota Medan. Dari hasil penelitian ditemukan bahwa Masalah prostitusi juga merupakan masalah struktural yang tidak hanya melibatkan pelacurnya saja, tetapi lebih dari itu melibatkan banyak orang seperti germo, para calo, serta pengguna jasa yang sering luput dari perhatian aparat penegak hukum, Faktor-faktor penyebab seorang melakukan tindakan pidana prostitusi sebagian besar masalahnya terletak pada faktor ekonomi dan faktor sosial, faktor ekonomi dipengaruhi oleh penghasilan atau kebutuhan seseorang, sedangkan faktor sosial dipengaruhi oleh lingkungan sekitar maupun pendidikan seseorang. Prostitution is also a very complex problem because it involves various aspects of community life, according to the author, there is a uniqueness in the practice of prostitution where the elements involved are commercial sex workers (PSK), (brokers) and the providers of places in criminal law who become suspects are only pimps and providers of places. PSK is a victim, prostitution as regulated in the Criminal Code Article 296 and Article 506 specifically regulates the provider of the place or who facilitates (Article 296) pimps (Article 506). The problems found in this study are the application of law against prostitution by a broker, a form of overcoming prostitution by a broker. The research objectives were to determine the application of the law against prostitution by a broker, to determine the form of prevention against prostitution by a broker, the research methods were normative juridical research, data collection techniques were literature research and interviews with the police at the Medan City Police. From the research results, it was found that the problem of prostitution is also a structural problem that does not only involve the prostitutes, but more than that it involves many people such as pimps, brokers, and service users who often escape the attention of law enforcement officials. Most of the problem in the crime of prostitution lies in economic and social factors, economic factors are influenced by one's income or needs, while social factors are influenced by the surrounding environment and one's education.
