dc.description.abstract | Pengangkatan Pegawai Negeri Sipil (PNS) pada jabatan Administrator dan jabatan pengawas di Kabupaten Simalungun oleh Pejabat Yang Berwenang tidak sesuai dengan persyaratan peraturan perundang-undangan yang ada, sehingga menimbulkan ketidakpastian hukum. Selain juga berdampak adanya kesenjangan antar Pegawai Negeri Sipil (PNS) di lingkungan Pemerintahan Kabupaten Simalungun. Berdasarkan hal tersebut, maka rumusan masalah dalam penelitian ini adalah: Pertama Bagaimana Pengaturan Hukum yang mengatur tentang pengangkatan Jabatan Administrator dan Jabatan Pengawas; Kedua, Faktor-faktor yang mempengaruhi Pejabat Pembina Kepegawaian Mengangkat PNS Dalam Jabatan Administrator Dan Jabatan Pengawas di Pemerintah Kabupaten Simalungun; dan Ketiga Bagaimana analisis kepastian hukum terhadap pengangkatan PNS Dalam Jabatan Administrator dan Jabatan Pengawas di Pemerintah Kabupaten Simalungun. Metode penelitian yang digunakan yaitu penelitian hukum normatif yang didukung dengan data empiris berupa wawancara, penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan undang- undang dan pendekatan konseptual. Seluruh data dan bahan hukum akan diinventarisir dan dianalis secara kualitatif. Adapun hasil penelitian ini yaitu, faktor sumber daya manusia dan ketidaktahuan pejabat yang berwenang menjadi faktor utama terjadinya pengangkatan yang tidak sesuai dengan syarat dan ketentuan. Dampak ketidakpastian hukum ini yaitu terjadinya kesenjangan antar pegawai dan kualitas serta motivasi pegawai untuk mengejar prestasi semakin berkurang. Rekomendasi dari penelitian ini yaitu, pengaturan terkait persyaratan pengangkatan Pegawai Negeri Sipil (PNS) dalam suatu Jabatan Administrator dan Jabatan Pengawas agar disosialisasikan secara utuh dan menyeluruh, Pemerintahan Kabupaten Simalungun seharusnya menggunakan prinsip-prinsip good governance dalam melaksanakan pengangkatan jabatan administrator dan jabatan pengawas. Ditekankan kepada Pejabat Pembina Kepegawaian memberhentikan Pegawai Negeri Sipil (PNS) dari jabatannya yang pengangkatannya tidak sesuai syarat dan ketentuan perundang-undangan yang berlaku, sehingga dapat menjamin kepastian hukum The appointment of Civil Servants (PNS) in Administrator positions and supervisory positions in Simalungun Regency by Competent Officials does not comply with the requirements of existing laws and regulations, causing legal uncertainty. As well as having an impact on the gap between Civil Servants (PNS) in the Simalungun Regency Government. Based on this, the formulation of the problems in this study are: First, what is the legal arrangement that regulates the appointment of Administrator and Supervisory Positions; Second, the factors that influence the Civil Service Officer to Appoint Civil Servants to the Position of Administrator and Supervisory Position in the Government of Simalungun Regency; and Third How is the analysis of legal certainty on the appointment of civil servants in the position of administrator and supervisory positions in the Simalungun Regency Government. The research method used is normative legal research supported by empirical data in the form of interviews. This research is descriptive analytical using a statutory approach and a conceptual approach. All data and legal materials will be inventoried and analyzed qualitatively. As for the results of this study, namely, the human resource factor and the ignorance of the authorized officials are the main factors in the occurrence of appointments that are not in accordance with the terms and conditions. The impact of legal uncertainty is that there is a gap between employees and the quality and motivation of employees to pursue achievements is decreasing. The recommendation of this research is that the regulation regarding the requirements for the appointment of Civil Servants (PNS) in an Administrator Position and Supervisory Position in order to be fully and thoroughly disseminated, the Simalungun Regency Government should use the principles of good governance in carrying out the appointment of administrator and supervisory positions. It is emphasized to the Civil Service Officer to dismiss Civil Servants (PNS) from their positions whose appointments do not comply with the terms and conditions of the applicable laws, so as to guarantee legal certainty. | en_US |
