dc.description.abstract | Tenaga kerja mempunyai peranan dan kedudukan yang sangat penting dalam pembangunan nasional. Sesuai dengan peranan dan kedudukan tenaga kerja, diperlukan pembangunan ketenagakerjaan untuk meningkatkan kualitas dan peran sertanya dalam pembangunan serta peningkatan perlindungan tenaga kerja dan keluarganya sesuai dengan harkat dan martabat kemanusiaan. Permasalahan dalam penelitian ini adalah: bagaimana faktor-faktor penyebab pekerja mengundurkan diri pada Putusan No. 306/Pdt.Sus-PHI/2018/PN.Mdn, bagaimana bentuk perlindungan hukum terhadap hak-hak pekerja yang mengundurkan diri pada Putusan No. 306/Pdt.Sus-PHI/2018/PN.Mdn dan bagaimana akibat hukum terhadap pekerja yang mengundurkan diri pada Putusan No. 306/Pdt.Sus- PHI/2018/PN.Mdn. Metode penelitian yang digunakan adalah penelitian normatif, yang memiliki sifat deskriptif analisis, serta menggunakan teknik pengumpulan data dengan studi kepustakaan yaitu berdasarkan peraturan perundang-undangan yang berlaku dan juga buku-buku terkait dan penelitian lapangan pada Pengadilan Negeri Medan, menggunakan analisis data secara kualitatif untuk mendapatkan hasil yang akurat untuk menjawab permasalahan yang dikaji. Hasil penelitian adalah faktor-faktor penyebab pekerja mengundurkan diri pada putusan No. 306/Pdt.Sus-PHI/2018/PN.Mdn alasan penggugat mengundurkan diri adalah karena Tergugat selaku pihak perusahaan Melakukan Demosi (Penurunan Jabatan) terhadap Penggugat, Tergugat telah melakukan pemotongan gaji Penggugat, Tergugat tidak Membayar Sewa Rumah Dinas Penggugat dan Tergugat tidak Membayar Sewa Kendaraan Dinas Penggugat. Bentuk perlindungan hukum terhadap hak-hak pekerja yang mengundurkan diri pada Putusan No. 306/Pdt.Sus-PHI/2018/PN.Mdn dengan memberikan hak-hak berupa uang penggantian hak perumahan dan perobatan berdasarkan Pasal 168 ayat 3 Undang-undang Nomor 13 tahun 2003 tentang Ketenagakerjaan, serta uang bantuan kos diluar domisili dan uang sewa kendaraan dinas operasional. Akibat hukum terhadap pekerja yang mengundurkan diri pada putusan No. 306/Pdt.Sus- PHI/2018/PN.Mdn adalah hubungan kerja antara Penggugat dengan Tergugat putus berdasarkan Pasal 168 ayat (1) Undang Undang No.13 tahun 2003 tentang Ketenagakerjaan (dikualifikasikan mengundurkan diri) sejak tanggal 30 Juni 2018, Menghukum Tergugat untuk membayar hak-hak Penggugat. Manpower has a very important role and position in national development. In accordance with the role and position of the workforce, it is necessary to develop manpower to improve the quality and participation in development and to increase the protection of workers and their families in accordance with human dignity. The problem in this research is: how are the factors that cause workers to resign in Decision No. 306 / Pdt.Sus-PHI / 2018 / PN.Mdn, what is the form of legal protection for the rights of workers who resign in Decision No. 306 / Pdt.Sus-PHI / 2018 / PN.Mdn and what are the legal consequences for workers who resign in Decision No. 306 / Pdt.Sus-PHI / 2018 / PN.Mdn. The research method used is normative research, which has a descriptive analytical nature, and uses data collection techniques with literature study, namely based on applicable laws and regulations as well as related books and field research at the Medan District Court, using qualitative data analysis to get accurate results to answer the problems studied. The results of the study are the factors that cause workers to resign in decision no. 306 / Pdt.Sus-PHI / 2018 / PN.Mdn The reason the plaintiff resigned was because the Defendant as the company carried out a Demotion (Decline of Position) against the Plaintiff, the Defendant had cut the Plaintiff's salary, the Defendant did not pay the Plaintiff's official residence and the Defendant did not pay Plaintiff's Service Vehicle Rental. The form of legal protection for the rights of workers who resign in Decision No. 306 / Pdt.Sus-PHI / 2018 / PN.Mdn by granting rights in the form of compensation for housing and medical treatment under Article 168 paragraph 3 of Law Number 13 of 2003 concerning Manpower, as well as boarding fees outside domicile and vehicle rental fees operational service. Legal consequences for workers who resigned in decision no. 306 / Pdt.Sus-PHI / 2018 / PN.Mdn is the working relationship between the Plaintiff and the Defendant who broke up based on Article 168 paragraph (1) of Law No.13 of 2003 concerning Manpower (qualified to resign) since 30 June 2018, punishing the Defendant to pay the Plaintiff's rights. | en_US |
