dc.description.abstractMetode yang digunakan adalah penelitian yuridis normatif dengan sifat penelitian deskriptif. Teknik pengumpulan data yang digunakan studi kepustakaan dan studi lapangan. Analisis data yang digunakan yaitu analisis kualitatif. Pengaturan hukum terhadap pekerja yang mengalami cacat dalam kecelakaan kerja. Pengaturan hukum terhadap pekerja yang mengalami cacat dalam kecelakaan kerja, tetap diberikan hak tanpa diskriminasi yang diatur pada Pasal 11 dan 32 UU No. 13 tahun 2003. Penerapan UU no 13 tahun 2003 dan UU no 19 tahun 2011 dikaitkan dengan UU No. 8 tahun 2016 terhadap putusan No.113/Pdt.sus-PHI/2016/PN.JKT.PST.Mengabulkan gugatan Penggugat untuk sebagian; Menyatakan Tergugat telah melakukan perbuatan yang bertentangan dengan UU No. 13 Tahun 2003; Menyatakan putus hubungan kerja antara Penggugat dengan Tergugat sejak putusan ini dibacakan; Menghukum Tergugat untuk membayar kompensasi kepada Penggugat berupa Uang Pesangon, Uang Penghargaan Masa Kerja, Uang Penggantian Hak, Pengganti sisa Cuti dan Upah proses yang seluruhnya sebesar Rp. 36.728.100, Kendala penyelesaian PHK pada pekerja yang cacat akibat kecelakaan kerja. Kalau kendala seharusnya tidak boleh ada, karena apa orang yang bekerja dan mendapatkan cacat dalam melaksanakan pekerjaannya seharusnya tetap dipekerjakan kembali kalau pun di PHK ya harus diberikan hak haknya, Kendala lainnya pasti pekerja tidak mau di PHK apabila itu terjadi maka ya dimutasi aja pekerja ditempat yang baru sesuai kemampuan pekerja tersebut. Tetapi apabila perusahaan mau mengajukan PHK harus diadakan bipartit dulu degan pekerja tersebut. The method used is a normative juridical research with descriptive research nature. The data collection techniques used are library research and field studies. The data analysis used is qualitative analysis. Legal arrangements for workers who are disabled in a work accident. Legal arrangements for workers who experience disabilities in work accidents are still given rights without discrimination as regulated in Articles 11 and 32 of Law no. 13 of 2003. The implementation of Law No. 13 of 2003 and Law No. 19 of 2011 is related to Law No. 8 of 2016 against Decision No. 113/Pdt.sus- PHI/2016/PN.JKT.PST. Partially granted the Plaintiff's claim; To declare that the Defendant has committed an act that is contrary to Law no. 13 of 2003; Declaring the termination of the employment relationship between the Plaintiff and the Defendant since this decision was read out; Sentencing the Defendant to pay compensation to the Plaintiff in the form of Severance Pay, Term of Service Reward, Entitlement Replacement Money, Compensation for the rest of Leave and Process Wage totaling Rp. 36,728,100,- Obstacles in completing layoffs for workers who are disabled due to work accidents. If there should be no obstacles, because if people who work and get disabled in carrying out their work should still be rehired, even if they are laid off, they must be given their rights. Another obstacle is that workers do not want to be laid off, if that happens, then just transfer the workers to the right place. according to the ability of the worker. But if the company wants to apply for layoffs, a bipartite agreement must first be held with the worker.en_US
