Abstract: Jenis penelitian dalam skripsi ini adalah normatif-empiris yang bersifat deskriptif analisis. Teknik Pengumpulan Data yang digunakan dalam penelitian ini adalah berasal dari data primer dan sekunder. Eksistensi force majeure dalam perjanjian sewa menyewa menurut KUHPerdata adalah melihat keadaan force majeure yang terjadi dalam perjanjian sewa menyewa. Peristiwa kebakaran adalah keadaan force majeure, namun tidak dapat dijadikan alasan untuk tidak dilaksanakannya prestasi dalam perjanjian sewa menyewa, dikarenakan pihak yang menyewakan telah berjanji kepada pihak penyewa untuk membangun kembali bangunan objek sewa menyewa, sehingga peristiwa kebakaran yang terjadi tidak dapat dikategorikan sebagai force majeure. Perlindungan hukum bagi pihak penyewa dan yang menyewakan terhadap keadaan force majeur secara umum diamanatkan oleh UUD 1945, Pasal 28D (1) dan Pasal 28G ayat (1). Pertimbangan Hakim dalam Perkara Nomor 307/Pdt/2019/PT Mdn sudah tepat, karena dalam perjanjian tersebut terdapat klausul ganti rugi atau pengembalian sisa uang sewa jika terjadi kebakaran. KUHPerdata tidak mengatur mengenai force majeure, disarankan kepada pembuat Undang-Undang agar membuat pengaturan khusus mengenai force majeure. Perlindungan hukum terhadap para pihak dalam suatu perjanjian tidak diatur secara khusus, disarankan bagi para pihak dalam membuat suatu perjanjian memasukkan klausula mengenai hal tersebut. Disarankan kepada hakim agar lebih jeli dan teliti dalam membuat pertimbangan hukum, dalam hal ini keputusan hakim sudah tepat. The type of research in this thesis is normative-empirical which is descriptive analysis. Data collection techniques used in this study were derived from primary and secondary data. The existence of force majeure in the lease agreement according to the Civil Code is to see the force majeure situation that occurs in the lease agreement. A fire event is a force majeure situation, but it cannot be used as an excuse for not carrying out the achievements in the lease agreement, because the renting party has promised the lessee to rebuild the leased object building, so that the fire event that occurs cannot be categorized as force majeure. Legal protection for the lessee and the lessor against force majeure is generally mandated by the 1945 Constitution, Article 28D (1) and Article 28G paragraph (1). The judge's consideration in Case Number 307/Pdt/2019/PT Mdn is correct, because in the agreement there is a compensation clause or refund of the remaining rent in the event of a fire. The Civil Code does not regulate force majeure, it is recommended that lawmakers make special arrangements regarding force majeure. Legal protection for the parties in an agreement is not specifically regulated, it is recommended for the parties in making an agreement to include a clause regarding this matter. It is recommended to the judge to be more observant and thorough in making legal considerations, in this case the judge's decision is correct.
