Abstract: | Permasalahan dalam penelitian ini adalah bagaimana perlindungan hukum terhadap debitur financial technology peer to peer lending terdampak covid-19, dan bagaimana efektivitas dari perlindungan hukum tersebut terhadap debitur financial technology peer to peer lending terdampak covid-19. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan deskriptif analisis yang mengarah pada penelitian hukum normatif. Hasil penelitian menyimpulkan perlindungan hukum terhadap debitur financial technology peer to peer lending terdampak covid-19 dilakukan dengan menambahkan penyelenggara Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi ke dalam Peraturan OJK (POJK) Nomor 58/POJK.05/2020 Tentang Perubahan Atas Peraturan OJK (POJK) Nomor 14/POJK.05/2020 Tentang Kebijakan Countercyclical Dampak Penyebaran Coronavirus Disease 2019 Bagi Lembaga Jasa Keuangan NonBank, sehingga penyelenggara financial technology peer to peer lending dapat melakukan restrukturisasi kredit kepada debitur terdampak covid-19 dengan memperhatikan pertimbangan-pertimbangan yang telah ditentukan. Efektivitas pelaksanaan perlindungan hukum terhadap debitur financial technology peer to peer lending yang telah dirumuskan terlihat melalui Tingkat Keberhasilan Bayar pada hari ke-90 (TKB90) pada financial technology peer to peer lending yang semakin mengalami peningkatan. The problem in this research is how is the legal protection for peer to peer lending financial technology debtors affected by covid-19, and how is the effectiveness of the legal protection for peer to peer lending financial technology debtors affected by covid-19. The method used in this research is normative juridical using a descriptive analysis approach that leads to normative legal research. The results of the study conclude that legal protection for financial technology peer to peer lending debtors affected by COVID-19 is carried out by adding information technology-based money lending service providers to OJK Regulation (POJK) Number 58/POJK.05/2020 concerning Amendments to OJK Regulations (POJK) Number 14/POJK.05/2020 concerning Countercyclical Policy on the Impact of the Spread of Coronavirus Disease 2019 for Non-Bank Financial Services Institutions, so that peer to peer lending financial technology providers can restructure credit to debtors affected by COVID-19 by taking into account the considerations that have been determined. The effectiveness of the implementation of legal protection for debtors of financial technology peer to peer lending that has been formulated can be seen through the Pay Success Rate on the 90th day (TKB90) in peer to peer lending financial technology which is increasingly increasing. |
