Peranan Kepolisian Dalam Penanggulangan Aksi Unjuk Rasa Anarkis (Studi di Polresta Medan)

Abstract

Suatu hal yang sangat berhubungan dengan peristiwa unjuk rasa adalah terjadinya hal-hal yang berakibat tidak baik yang menyertai unjuk rasa tersebut yaitu terjadinya tindakan anarkis. Kepolisian yang bertindak mengamankan jalannya unjuk rasa bertanggungjawab atas keamanan dan ketertiban masyarakat. Penelitian ini bertujuan untuk mengetahui peran, tugas pokok dan fungsi POLRI dalam menjaga Keamanan sesuai Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian Negara RI, untuk mengetahui penanggulangan aksi unjuk rasa anarkis di wilayah hukum Polresta Medan dan untuk mengetahui hambatan dalam penanggulangan aksi unjuk rasa anarkis di wilayah hukum Polresta Medan. Jenis penelitian ini adalah penelitian hukum normatif dan yuridis empiris. Data diperoleh melalui studi kepustakaan berupa bahan hukum primer, sekunder dan bukan hukum dan studi lapangan berupa kegiatan wawancara dengan informan. Metode analisis data yang dilakukan dalam penelitian ini adalah analisis kualitatif. Hasil penelitian menunjukkan bahwa tugas pokok dan fungsi Polresta Medan dalam menjaga keamanan dilaksanakan sesuai dengan aturan UU No. 2/2002 tentang Kepolisian Negara RI. Penanggulangan aksi unjuk rasa anarkis dilaksanakan sesuai aturan hukum, dan hambatan dari faktor internal yaitu kurangnya kordinasi dengan instansi terkait dan kurangnya jumlah aparat kepolisian; faktor eksternal yaitu banyak masyarakat yang menonton, massa menjadikan anak-anak dan wanita menjadi tameng, kemacetan lalu lintas, dan kurangnya kesadaran hukum pengunjuk rasa. Disarankan agar pihak Kepolisian melakukan upaya preventif seperti melaksanakan sosialisasi hukum kepada masyarakat, meningkatkat personil secara kuantitas dan kualitas, meningkatkan perlengkapan Dalmas sesuai kebutuhan dan ke depannya pihak Kepolisian bertindak tegas melakukan penyidikan terhadap pelaku unjuk rasa anarkis. This study aims to determine the role, duties and functions of the National Police of Republik Indonesia (POLRI) in maintaining security in accordance to the Law No. 2 of 2002 on the POLRI, to find out countermeasures rallies anarchist in the jurisdiction of Police Resort Medan (Polresta), and to find out the obstacles in tackling rallies anarchists. This research is a normative legal research and empirical jurisdiction. Data obtained through the study of literature in the form of primary legal materials, secondary and the data is not a legal entity and field studies through interview with informants. Methods of data analysis in this research is qualitative analysis. The results showed that the duties and functions of the police in Polresta Medan in maintaining security is implemented in accordance with the rules of the Law No. 2 of 2002 on the POLRI. Countermeasures anarchist rallies conducted in accordance with the rule of law, and the resistance of the internal factors are the lack of coordination with the relevant agencies and the insufficient number of police officers; external factors that many people watching, mass makes children and women become a shield, traffic congestion, and lack of legal awareness protesters. It is recommended to the police to undertake preventive measures such as the dissemination of the law to the public, increasing the quantity and quality of personnel, improve the crowd control (Dalmas) equipment according to the needs and going beyond the police to act decisively to investigate such anarchist demonstrators.
