Abstract: Alternatif penyelesaian kredit bermasalah merupakan persoalan krusial bagi manajemen kredit dalam menentukan kredit akan tetap dilanjutkan dengan berbagai kebijakan perubahan atas fasilitas dan persyaratannya atau di akhiri dengan mengeksekusi agunan debitur. Kedua pilihan bagi manajemen kredit mengandung resiko dan memberikan dampak bagi kinerja bank. Bila manajemen kredit menyelesaikan kredit bermasalah dengan mengesuki agunan, persoalan kredit bermasalah bukan berarti selesai. Pengambilalihan agunan merupakan polemik antara ketentuan yang tercantum dalam undang undang no 10 tahun 1998 tentang perubahan atas undang no 7 tahun 1992 tentang perubahan atas undang no 7 tahun 1992 tentang perbankan undang ini mengatur persoalan hukum jaminan yang dijadikan acuan bagi pelaku bisnis bank. Alternative settlement of non-performing loans is a crucial issue for credit management in determining that credit will continue with various policy changes to its facilities and requirements or end by executing debtor's collateral. Both options for credit management carry risks and have an impact on bank performance. If credit management resolves non-performing loans by entering collateral, the problem of non-performing loans does not mean it is over. The takeover of collateral is a polemic between the provisions contained in Law No. 10 of 1998 concerning amendments to Law No. 7 of 1992 concerning Amendments to Law No. 7 of 1992 concerning Banking.
