Abstract: Di Asuransi terdapat perjanjian asuransi, dijelaskan dalam KUHPerdata menyatakan adanya “kesepakatan” yang merupakan syarat yang harus dipenuhi untuk sahnya perjanjian tersebut, dalam meninjau perlindungan hukum dari pemegang polis dijelaskan terlebih dahulu dari aspek hukum, perjanjian asuransi akan membentuk hubungan hukum yang tercermin dalam perjanjian, kemudian perjanjian yang mengatur persyaratan dan kewajiban. Kedua belah pihak harus memenuhi komitmennya sesuai dengan posisi masing-masing sebagai tertanggung dan penjamin, pentingnya bisnis perasuransian dalam perkembangannya untuk memajukan perkembangan perasuransian. Premi harus dibayar tepat waktu, jika tertanggung beresiko saat polis jatuh tempo, penanggung tidak akan dapat memenuhi kewajibannya untuk membayar klaim kepada tertanggung. Tertanggung belum memenuhi kewajiban membayar premi tepat waktu, sehingga klaim asuransi yang diajukan ditolak oleh perusahaan asuransi karena sudah dalam keadaan Lapse. Tidak membayarkan premi bukan kesalahan tertanggung melainkan kelalaian dari agen asuransi yang tidak menyetorkan premi ke perusahaan asuransi. Permasalahan yang diangkat dalam penelitian ini yaitu Bagaimana pengaturan agen dalam perusahaan asuransi di Indonesia. Bagaimana pertanggungjawaban perusahaan asuransi terhadap nasabah yang mengalami polis lapse akibat kelalaian agen dalam pembayaran angsuran premi (Putusan No.320.G/2019/PN Mdn). Metode penelitian dalam skripsi ini adalah Library Research yaitu peneliti yang dilakukan berdasarkan sumber bacaan, yaitu undang-undang, buku-buku, penelitian ilmiah, internet, jurnal, penelitian lapangan. Dalam hal ini, peneliti langsung melakukan penelitian ke PN Medan dengan cara wawancara. Hasil penelitian yang diperoleh yaitu tergugat (PT Prudential life Assurance) sama sekali tidak bertanggungjawab dan sama sekali tidak ada Itikad baik terhadap penggugat (yurnawilis) atas pengklaiman asuransi tertanggung Alm. Ambun Sari (ibu kandung penggugat), karena perkara ini juga dinyatakan sebagai obscuur libel (kabur) dimana posita dan petitum si penggugat yang tidak berkaitan, bukan berarti dari pihak tergugat sama sekali tidak bertanggungjawab atas pengklaiman asuransi si penggugat dan hal tersebut sangat merugikan dari pihak penggugat yang dari pihak tergugat sangat diuntungkan. In Insurance there is an insurance agreement, explained in the Civil Code which states that there is an "agreement" which is a condition that must be fulfilled for the validity of the agreement, in reviewing the legal protection of the policyholder, it is explained first. From the legal aspect, the insurance agreement will form a legal relationship which is reflected in the agreement, then an agreement that stipulates the terms and obligations. Both parties must fulfill their commitments in accordance with their respective positions as the insured and the insurer, the importance of the insurance business in its development to advance the development of insurance. Premiums must be paid on time, if the insured bears the risk at the end of the policy, the insurer will not be able to fulfill his obligations to pay claims to the insured. The insured has not fulfilled the obligation to pay premiums on time, so the insurance claim submitted is rejected by the insurance company because it is in a state of lapse. Not paying the premium is not the insured's fault but the negligence of the insurance agent who did not deposit the premium to the insurance company. The problem raised in this study is how to regulate agents in insurance companies in Indonesia. What is the responsibility of the insurance company to customers who experience policy lapse due to the agent's negligence in paying premium installments (Decision No. 320.G/2019/PN Mdn). The research method in this thesis is Library Research, namely researchers who are carried out based on reading sources, namely laws, books, scientific research, internet, journals, field research. In this case the researchers directly conducted research to the Medan District Court by means of interviews. The result obtained is that the Defendant (PT Prudential Life Assurance) is completely irresponsible and has absolutely no good faith towards the Plaintiff (Yurnawilis) for the insurance claim of the deceased insured. Ambun Sari (the plaintiff's biological mother), because this case was also declared obscuur libel (blurred) where the posita and the plaintiff's petition are not related, does not mean that the defendant is not at all responsible for the plaintiff's claim. plaintiff's insurance and this is very detrimental to the party. the plaintiff of the defendant greatly benefited.
