Peran Kepolisian Dalam Penegakan Hukum Tindak Pidana Penyelundupan Impor Pakaian Bekas (Studi pada Kepolisian Daerah Sumatera Utara)

Abstract

Negara Indonesia merupakan negara yang kaya akan bumi, air, ruang angkasa, dan sumber daya alam lainnya. Impor merupakan pembelian barang dan jasa dari luar negeri kedalam negeri. Isu perdagangan pakaian bekas sudah meluas diberbagai dunia baik di negara maju maupun berkembang. Di Indonesia pakaian bekas masuk melalui pelabuhan-pelabuhan tikus yang ada di Indonesia, khususnya daerah Sumatera Utara. Berdasarkan hal tersebut rumusan masalah dalam penelitian ini: 1) Bagaimana aturan hukum tentang penyelundupan impor pakaian bekas, 2) Bagaimana peran kepolisian dalam penegakan hukum tindak pidana penyelundupan impor pakaian bekas di wilayah Sumatera Utara, 3) Bagaimana kendala yang dihadapi kepolisian dalam penegakan hukum tindak pidana penyelundupan impor pakaian bekas di wilayah Sumatera Utara. Adapun metode penelitian yang digunakan adalah metode yuridis normatif dan sifat penelitian deskriptif analis. Hasil penelitian menunjukkan bahwa aturan hukum tentang tindak pidana impor pakaian bekas diatur dalam UU No. 7 Tahun 2014 tentang Perdagangan, UU No. 17 Tahun 2006 tentang perubahan atas UU Kepabeanan, dan Peraturan Menteri Perdagangan No.51 /M-DAG/PER/7/2015 Tentang Larangan Impor Pakaian Bekas. Peran Kepolisian bahwa Polda Sumut bekerjasama dengan pejabat bea cukai dan melakukan pemeriksaan dokumen atau kelengkapan perijinan bergeraknya suatu barang dalam hal ini pakaian bekas dari luar negeri yang akan diantar ke kota padang melalui perairan Tanjung Balai. Adapun kendala yang dihadapi dalam penegakan hukum tindak pidana penyelundupan adalah faktor hukum dimana Polda Sumut tidak mempunya kendala dari faktor hukum karena aturan hukumnya sudah jelas, faktor penegakan hukum dimana personil Polda Sumut lalai dalam menjalankan tugasnya sehingga para supir melarikan diri, faktor sarana dan prasarana Polda Sumut tidak memiliki kendala, karena sarana dan prasarana telah lengkap, faktor masyarakat dimana masyarakat masih banyak tidak melapor kepada aparat penegak hukum terkait masuknya pakaian bekas ke Indonesia khususnya Sumatera Utara dan faktor kebudayaan dimana masyarakat merasa enak untuk berjualan pakaian bekas.. Disarankan, masyarakat harus memberikan contoh yang baik dan dapat bekerjasama kepada pihak penegakan hukum dalam hal ini Kepolisian maupun Petugas Bea Cukai dalam memerangi tindak pidana penyelundupan. The issue of the secondhand clothing trade has spread throughout the world, both in developed and developing countries. In Indonesia, used clothes enter through rat ports in Indonesia, especially the North Sumatra area. Based on this, the formulation of the problem in this study: 1) What are the legal rules regarding smuggling of imports of used clothing, 2) What is the role of the police in law enforcement of criminal acts of smuggling imports of used clothing in North Sumatra, 3) What are the obstacles faced by the police in law enforcement? the crime of smuggling used clothing imports in the North Sumatra region. The research method used is the normative juridical method and the nature of the descriptive analysis of the analyst. The results of the study indicate that the legal rules regarding the criminal act of importing used clothing are regulated in Law no. 7 of 2014 concerning Trade, Law no. 17 of 2006 concerning amendments to the Customs Law, and Regulation of the Minister of Trade No.51/M- DAG/PER/7/2015 concerning the Prohibition of the Import of Used Clothing. The role of the Police is that the North Sumatran Police cooperate with customs officials and inspect documents or permits for the movement of an item, in this case used clothing from abroad, which will be delivered to the city of Padang via Tanjung Balai waters. The obstacles faced in law enforcement of the crime of smuggling are legal factors where the North Sumatran Police do not have legal constraints because the legal rules are clear, law enforcement factors where North Sumatra Police personnel are negligent in carrying out their duties so that the drivers run away, Regional Police facilities and infrastructure factors North Sumatra has no problems, because the facilities and infrastructure are complete, the community factor where many people still don't report to law enforcement officials regarding the entry of used clothes into Indonesia, especially North Sumatra and cultural factors where people feel comfortable selling used clothes. provide a good example and be able to cooperate with law enforcement in this case the Police and Customs Officers in combating the crime of smuggling.
