Implementasi Restorative Justice Dalam Kecelakaan Arus Lalu Lintas Di Lima Puluh Kota

Abstract

Masalah utamanya adalah kecelakaan lalu-lintas. Dalam kurun waktu 6 tahun terakhir, kecelakaan lalu lintas yang terjadi di Indonesia telah merenggut korban jiwa rata-rata pertahunnya adalah 88.897dan di tahun 2015 naik menjadi 96.07 dan tingkat kenaikan kecelakan lalu lintas semakin naik terus di tahun 2019 semakin menigkat pastinya jumlah dari kecelakan lalau lintas adalah 107.500 menigkat dari jumlah sebelumnya, selanjutnya Kecelakaan selain menimbulkan korban jiwa, juga menimbulkan kerugian secara finansial/material. Hal ini sangat memprihatinkan apabila tidak dilakukan langkah-langkah strategis guna meningkatkan keselamatan dan kepatuhan hukum dalam lalu lintas. Para pihak yang mengalami kecelakaan dapat menyesaaikan dengan cara mediasi penal, atau lebih di kenal dengan istilah Restorative Justice Ada pun rumusan masalah saya adalah Bagaimana peran kepolisi an dalam pelaksanaan Restorative Justice terhadap kecelakaan arus Lalu lintas di lima puluh kota Bagaimana peran kepolisian dalam pelaksanaan Restorative Justice terhadap kecelakaan arus Lalu lintas di lima Puluh Kota. Ada pun tujuan penelitan ini Untuk mengetahui penerapan Restorative Justice. Terhadap Kecelakaan Lalu Lintas dan untuk mengetah ui Faktor-Faktor apa saja peyebab kecelakan lalu lintas tersebut Peneliti melaksanakan penelitian di LIMA PULUH KOTA Ada pun metode pelelitian penulis Dengan menggunakan teknik pengumpulan data, memalalui wawancara (interview) dengan Kanit Laka dan memeriksa sekaligus menjadi fasilator dalam kasus kecelakan lalu lintas di Kasat Lantas Poltes LIMA PULUH KOTA. Dengan menggunakan metode Yuridis Normative yaitu, metode penelitian yang mengkaji studi dokumen, yakni menggunakan berbagai data sekunder seperti peraturan perundang-undanagan, keputusam pengadilan, teori hukum dan dapat juga berupa pendapat para sarjana. Hasil dari penelitian ini adalah IMPLEMENTASI RESTORATI JUSTICE DALAM KECELAKAN ARUS LALU LINTAS DI LIMA PULUH KOTA. Dan ada pun saran dari penulis yaitu diharapkan kepada para kepolisian memberikan sosialisasi kepada masyarakat pentingnya dalam perkara Restorative Justice.-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------The main problem is traffic accidents. The parties who have an accident can settle it by means of penal mediation, or better known as Restorative Justice As for the formulation of my problem, what is the role of the police in the implementation of Restorative Justice for traffic accidents in fifty cities? Against Traffic Accidents and to find out what factors are the cause of the traffic accident, the researcher conducted research in FIFTY CITY As for the research method, the author uses data collection techniques, through interviews (interviews) with the Head of Laka and checking as well as being a facilitator in cases of traffic accidents at the Head of Traffic Police of FIVE PULUH CITY. By using the Juridical Normative method, namely, a research method that examines document studies, which uses various secondary data such as legislation, court decisions, legal theory and can also be in the form of opinions of scholars. The result of this research is IMPLEMENTATION OF RESTORATION JUSTICE IN TRAFFIC FLOW ACCIDENTS IN FIFTY CITIES. And there is also a suggestion from the author, which is that it is hoped that the police will provide socialization to the community about the importance of Restorative Justice cases
