dc.description.abstract | Pro-kontra hukuman mati bagi pelaku tindak pidana di Indonesia kembali marak diperbincangkan meski perdebatan serupa telah berulang kali terjadi pada tahun-tahun sebelumnya. Pelaksanaan hukuman mati di Indonesia juga masih diterapkan. Dalam kurun waktu 10 tahun terakhir, tidak kurang dari 24 orang telah dihukum mati atas tindak pidana yang beragam, 16 orang diantaranya kasus tindak pidana narkotika. Berdasarkan hal tersebut rumusan masalah dalam penelitian ini adalah 1) Bagaimana pengaturan pidana mati terhadap tindak pidana narkotika di Indonesia, 2) Bagaimana kedudukan pidana mati dalam undang-undang narkotika sehubungan dengan HAM pada UUD 1945, 3) Bagaimana dasar pertimbangan hakim dalam menjatuhkan hukuman mati kepada perantara jual beli narkotika dalam Putusan Nomor 1333/Pid.Sus/2019/PN.Mdn. Metode analisisi data yang digunakan kualitatif. Hasil penelitian ini menunjukkan bahwa pengaturan pidana mati terhadap pidana narkotika di Indonesia dinyatakan dalam UU Narkotika No, 35 tahun 2009, yaitu pada pasal 113, 114, 116, 118, 119, 121, 132 serta pasal 133. Tindak pidana perantara jual beli narkotika diatur pasal 114 Ayat (2), yaitu dalam hal perbuatan menawarkan untuk di jual, menjual, membeli, menjadi perantara dalam jual beli, menukar, menyerahkan, atau menerima Narkotika Golongan I sebagaimana dimaksud pada ayat (1) yang dalam bentuk tanaman beratnya melebihi 5 (lima) batang pohon atau dalam bentuk bukan tanaman beratnya 5 (lima) gram, pelaku dipidana dengan pidana mati, pidana penjara seumur hidup, atau pidana penjara paling singkat 6 (enam) tahun dan paling lama 20 (dua puluh) tahun dan pidana denda maksimum sebagaimana dimaksud pada ayat (1) ditambah 1/3 (sepertiga).Menurut Mahkamah Konstitusi bahwa pidana mati tidak bertentangan dengan HAM dalam UUD 1945, karena dalam konstitusi tersebut penerapan HAM tidak bersifat mutlak. Penerapan HAM dalam UUD 1945 dibatasi oleh pasal selanjutnya yang merupakan pasal kunci yaitu pasal 28J, yang berbunyi: hak azasi seseorang digunakan dengan harus menghargai dan menghormati hak azasi orang lain demi berlangsungnya ketertiban umum dan keadilan sosial. Tetapi praktisi hukum menyatakan bahwa pidana mati bertentangan dengan HAM dan tidak sesuai dengan pembaharuan hukum pidana di Indonesia.Majelis hakim pada Pengadilan Negeri Medan telah menjatuhkan pidana mati kepada terdakwa A UPEK karena tanpa hak dan melawan hukum menjadi perantara dalam jual beli dan menyerahkan Narkotika Golongan I bukan tanaman jenis shabu-shabu dan extacy yang beratnya lebih dari 5 (lima) gram. Jumlah narkotika yang dibawa terdakwa juga tergolong besar, yaitu 45 (empat puluh lima) bungkus Narkotika jenis shabu, 40.000,- (empat puluh ribu) butir Narkotika jenis extacy serta 6 (enam) Kg Narkotika jenis keytamin.Disarankan RUU KUHP dianggap menjadi jalan tengah atas polemik penerapan pidana mati di Indonesia dengan memberi kesempatan tindakan korektif terhadap pidana mati yang dijatuhkan oleh majelis hakim. Oleh karena itu pemerintah perlu segera merampungkan pembahasan RUU KUHP dengan menganalisis lebih mendalam pasal-pasal yang ditolak oleh masyarakat, sehingga RUU tersebut segera dapat disahkan.Para penegak hukum perlu lebih aktif untuk dapat menjerat pelaku-pelaku lainnya dalam tindak pidana narkotika yang secara bersama-sama dilakukan dengan terdakwa, agar jaringan peredaran narkotika tersebut benar-benar dapat diberantas.Pemerintah perlu menyediakan solusi untuk mengatasi masalah yang timbul terhadap kehidupan istri dan anak-anak terdakwa yang dipidana mati secara khusus yang telah dieksekusi, karena pemerintah bertanggungjawab atas segala dampak yang timbul dari tindakannya kepada masyarakat. The pros and cons of the death penalty for criminals in Indonesia are being discussed again, although similar debates have repeatedly occurred in previous years. The implementation of the death penalty in Indonesia is also still being applied. In the last 10 years, no less than 24 people have been sentenced to death for various crimes, 16 of them are cases of narcotics crimes. Based on this, the formulation of the problems in this research are 1) How is the death penalty regulation for narcotics crime in Indonesia, 2) What is the position of the death penalty in the narcotics law in relation to human rights in the 1945 Constitution, 3) What is the basis for the judge's consideration in imposing the death penalty to intermediaries for the sale and purchase of narcotics in Decision Number 1333 / Pid.Sus / 2019 / PN.Mdn. The data analysis method used is qualitative. The results of this study indicate that the regulation of capital punishment against narcotics crime in Indonesia is stated in the Narcotics Law No. 35 of 2009, namely in articles 113, 114, 116, 118, 119, 121, 132 and article 133. The crime of trafficking in narcotics is regulated. Article 114 Paragraph (2), namely in the event that the act of offering to sell, sell, buy, become an intermediary in the sale and purchase, exchange, deliver, or receive Narcotics Category I as referred to in paragraph (1) which in the form of plants the weight exceeds 5 ( five) tree trunks or in non-plant form weighing 5 (five) grams, the perpetrator shall be sentenced to death penalty, life imprisonment, or imprisonment for a minimum of 6 (six) years and a maximum of 20 (twenty) years and a maximum fine. as referred to in paragraph (1) plus 1/3 (one third). According to the Constitutional Court, the death penalty does not contradict human rights in the 1945 Constitution, because in the constitution the application of human rights is not contiguous. absolute fat. The application of human rights in the 1945 Constitution is limited by the following article which is a key article, namely article 28J, which reads: a person's human rights are used by respecting and respecting the human rights of others for the sake of public order and social justice. However, legal practitioners state that capital punishment is against human rights and inconsistent with the reform of criminal law in Indonesia. The judges at the Medan District Court have sentenced defendant A UPEK to death for being without rights and illegally acting as an intermediary in buying and selling and handing over Narcotics Category I not plant types of methamphetamine and extacy which weigh more than 5 (five) grams. The number of narcotics carried by the defendant was also quite large, namely 45 (forty five) packs of methamphetamine narcotics, 40,000 (forty thousand) extacy narcotics and 6 (six) kg of keytamine narcotics. It is suggested that the Criminal Code Bill is considered a middle way on the polemic of the application of the death penalty in Indonesia by providing opportunities for corrective action against the death penalty imposed by the panel of judges. Therefore, the government needs to immediately complete the discussion of the Draft Criminal Code by analyzing more deeply the articles rejected by the public, so that the bill can be passed immediately. Law enforcers need to be more active in being able to ensnare other perpetrators in narcotics crime collectively. The same was done with the defendant, so that the narcotics distribution network could really be eradicated. The government needed to provide a solution to overcome the problems that arose in the life of the wife and children of the accused who was sentenced to death specifically who had been executed, because the government was responsible for all the impacts that arose. of his actions to society. | en_US |
