dc.description.abstract | Pembangunan Infrastruktur masih menjadi fokus pemerintah hingga saat ini. Ada sejumlah proyek strategis nasional yang digenjot Pemerintah, salah satunya adalah Pembangunan Infrastruktur Ketenagalistrikan. Dalam melaksanakan Pembangunan Infrastuktur Ketenagalistrikan, ketersediaan lahan menjadi syarat yang harus dipenuhi, dan tidak menutup kemungkinan lokasi pembangunan menggunakan Kawasan Hutan. Pada penelitian ini, permasalahan yang dikaji adalah proses pelaksanaan pengadaan tanah untuk pembangunan PLTA Asahan 3 yang berada pada kawasan hutan, kemudian mekanisme penyelesaian hukum terhadap lahan kawasan hutan yang dikuasai masyarakat dalam rangka Pembangunan Infrastruktur Ketenagalistrikan. Penelitian ini merupakan penelitian yuridis normatif, bersifat deskriptif analisis melalui pendekatan kualitatif, dengan menggunakan sumber data sekunder yang diperoleh dari bahan literatur dan berkaitan dengan objek penelitian. Berdasarkan hasil penelitian yang diperoleh bahwa, pelaksanaan pengadaan tanah pada Kawasan Hutan untuk Pembangunan PLTA Asahan 3 adalah melalui mekanisme Izin Pinjam Pakai Kawasan Hutan. Dalam hal ini, PT PLN (Persero) wajib mengajukan permohonan kepada Menteri Lingkungan Hidup dan Kehutanan. Pengusaaan tanah dalam kawasan hutan yang dilakukan masyarakat didasarkan atas hasil membuka lahan hutan oleh orang tua mereka, kemudian diteruskan pada generasi berikutnya. Penguasaan tersebut berlangsung lama sehingga meyakinkan masyarakat bahwa tanah yang mereka kuasai adalah hak milik yang timbul berdasarkan hukum adat. Penyelesaian hukum yang dapat dilakukan oleh PT PLN (Persero) terhadap penguasaan lahan tersebut adalah melalui ketentuan Peraturan Menteri ESDM Nomor 33 Tahun 2016 dengan pelaksanaan Penyelesaian Teknis (pemberian sejumlah uang) Terhadap Tanah, Bangunan, dan/atau Tanaman yang dikuasai masyarakat pada kawasan hutan dalam rangka Percepatan Pembangunan Infrastruktur Ketenagalistrikan. Infrastructure development is still the government's focus until now. There is a number of national strategic projects promoted by the Government, one of which is Electricity Infrastructure Development. In carrying out development Electricity infrastructure, the availability of land is a condition that must be met, and does not rule out the possibility of the development location using the Forest Area. In this study, the problem studied is the process of implementing procurement land for the construction of the Asahan 3 hydropower plant which is located in a forest area, then mechanism for legal settlement of forest areas controlled by the community in the framework of Electricity Infrastructure Development. This research is normative juridical research, descriptive analysis through a qualitative approach, with using secondary data sources obtained from literature and related to object of research. Based on the research results obtained that, the implementation of land acquisition in The Forest Area for the Asahan 3 Hydroelectric Power Plant Development is through the Borrow Permit mechanism Use Forest Area. In this case, PT PLN (Persero) is required to apply for to the Minister of Environment and Forestry. Land tenure in forest areas what the community does is based on the results of clearing forest land by parents them, then passed on to the next generation. The mastery lasts so long as to convince the community that the land they control is their property arising under customary law. Legal settlement that can be done by PT PLN (Persero) for the control of the land is through the provisions of the Regulations Minister of Energy and Mineral Resources Number 33 of 2016 with the implementation of Technical Settlement (granting of amount of money) on land, buildings, and/or plants controlled by the community in forest areas in the context of the Acceleration of Electricity Infrastructure Development. | en_US |
