dc.description.abstract | Bagi seorang pekerja atau buruh yang terkena Pemutusan Hubungan Kerja (PHK) berdampak sangat luas bagi kehidupannya dan tidak hanya kehidupannya saja tetapi juga sangat berdampak terhadap kehidupan keluarganya. Disaat pekerja/buruh tersebut berhenti atau di PHK oleh perusahaan maka seharusnya perusahaan tersebut mengeluarkan pesangon atau tunjangan lain yang berkaitan dengan pemberhentian tersebut. Dalam penelitian ini Penulis menggunakan jenis penelitian Yurisis Normatif dan menggunakan Teknik Pengumpulan data yaitu Studi dokumen yaitu bahan-bahan kepustakaan dan dokumen-dokumen yang berkaitan dengan permasalahan yang dikemukakan dan Penelitian Lapangan (Field Research): wawancara yaitu penulis yang langsung melakukan studi Pengadilan Negeri Medan untuk mengambil contoh kasus tentang pemutusan hubungan kerja secara sepihak dalam Putusan No. 93/Pdt.Sus-PHI/2021/Pn.Mdn. Penyelesaian PHK sepihak diatur dalam undang-undang no 13 tahun 2003 tentang Keternaga Kerjaan dan undang-undang no 11 tahun 2020 tentang Cipta Kerja, yang mana pada Nomor 37 yang memuat ketentuan tentang pasal 151 diantarnya, berisikan bahwa PHK harus dihindarkan, apabila PHK tidak dapat dihindarkan maka harus dijelaskan alasan kenapa karyawan di PHK, dan apabila buruh menolak alasan PHK maka harus dilakukan Bipartit antara Pengusaha dan Buruh, apabila tidak menemukan jalan keluar maka dilanjutkan dengan Tripartit di Dinas Ketenagakerjaan Kabupaten dan atau Kota. Bahwa sebagaimana yang dimuat dalam Putusan No. 93/Pdt.Sus- PHI/2021/Pn.Mdn., sebagai akibat Hukum yang harus diterima oleh pihak perushaan adalah Perusahaan harus membayar akibat hukum yang diterimanya sebagimana yang dimuat dalam amar putusan dalam putusan tersebut, hal tersebut harus dijalankan apabila putusan tersebut sudah berkekuatan hukum atau inkracht Bahwa dasar Pertimbangan hakim adalah terdiri dari Gugatan, eksespsi/jawaban, Replik, Duplik Bukti surat, saksi yang diajukan oleh Penggugat dan Tergugat dalam Persidangan, dasar tersebut dimuat dalam Putusan No. 93/Pdt.Sus- PHI/2021/Pn.Mdn. bahwa dasar yang menguatkan Penggugat adalah , telah dilakukan bipartit antara pengusaha dan karyawan yang menghasilakn kesepakatan bersama tapi tidak dijalankan Perusahaan yang isinya untuk mempekerjakan kembali karyawan, bahwa karyawan telah melakukan tripartit yaitu mediasi ke disnaker dan dikeluarkan anjuran sebagimana yang dimuat dalam kesepakatan bersama akan tetapi perusahaan mengindahkanya, sehingga diajukan gugatan ke Pengadilan Hubungan Industrial (PHI) sehingga dasar tersebut yang memenangkan Penggugat. For a worker or laborer who is affected by Termination of Employment (PHK) it has a very broad impact on his life and not only his life but also greatly affects the life of his family. When the worker/laborer quits or is laid off by the company, the company should issue severance pay or other benefits related to the dismissal. In this study the author uses normative juridical research and uses data collection techniques, namely document studies, namely library materials and documents related to the problems raised and field research (Field Research): interviews, namely writers who directly conduct studies at the Medan District Court to take as an example the case of unilateral termination of employment in Decision No. 93/Pdt.Sus-PHI/2021/Pn.Mdn. The settlement of unilateral layoffs is regulated in Law No. 13 of 2003 concerning Employment and Law No. 11 of 2020 concerning Job Creation, which in Number 37 which contains provisions concerning Article 151 of them, contains that layoffs must be avoided, if the layoff cannot be fulfilled. If this is avoided, the reasons why the employee is laid off must be explained, and if the worker refuses the reason for the layoff, a bipartite agreement must be carried out between the Employer and the Worker, if a solution cannot be found, it will be followed up with Tripartite at the Regency and/or City Manpower Office. That as stated in Decision No. 93/Pdt.Sus-PHI/2021/Pn.Mdn., as a result of the law that must be accepted by the company is that the company must pay the legal consequences it receives as contained in the ruling in the decision, this must be carried out if the decision has been legally enforceable or inkracht Whereas the basis for the judge's consideration consists of the lawsuit, exception/answer, the Replic, the duplicate of the evidence, the witnesses presented by the Plaintiff and the Defendant in the Trial, the basis of which is contained in Decision No. 93/Pdt.Sus-PHI/2021/Pn.Mdn. that the basis that strengthens the Plaintiff is that a bipartite agreement was carried out between the entrepreneur and the employee which resulted in a collective agreement but was not carried out by the Company with the contents of re-employing employees, that the employee had carried out tripartite, namely mediation to the Manpower Office and issued a recommendation as contained in the collective agreement but the company heeded it, so that a lawsuit was filed with the Industrial Relations Court (PHI) so that the basis was in favor of the Plaintiff. | en_US |
