dc.description.abstract | Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap konsumen akibat wanprestrasi dalam jual beli rumah melalui developer di Kota Medan. Penelitian dilakukan di Kantor Perum Perumnas Regional I dengan mengambil data serta melakukan wawancara untuk melengkapi penelitian ini. Jenis Penelitian pada karya ilmiah ini menggunakan penelitian hukum normatif. Mekanisme jual beli melalui developer diatur dengan menggunaan perjanjian Pengikatan Jual Beli adalah sah dan mempunyai kekuatan hukum serta mengikat apabila mendasarkan pada ketentuan pasal 1320 KUH Perdata, dengan terpenuhinya semua syarat meliputi syarat subjektif yaitu adanya kata sepakat dan kecapakan para pihak serta syarat objektif meliputi adanya hal tertentu serta causa yang halal. Oleh karena kemampuan/daya beli dari pembeli tidak mencukupi untuk dapat melakukan pembelian secara tunai maka dilaksanakanlah Pengikatan Jual Beli dihadapan notaris. Serta bentuk bentuk perlindungan hukum konsumen perumahan atas suatu perjanjian yang dilakukannya dengan pelaku usaha, dalam hal ini pengembang perumahan. Serta memberikan kepastian hukum bagi konsumen perumahan bahwa apa yang ada dalam perjanjian yang dilakukan harus sesuai dengan barang dan/atau jasa yang diperjanjikan. Konsumen sebagai pengguna barang dan/atau jasa dalam hal ini rumah atau hunian berhak atas tanggung jawab pengembang perumahan apabila perumahan yang yang dibelinya terdapat cacat, kerusakan yang mengakibatkan kerugian. This study aims to find out legal protection for consumers due to default in buying and selling houses through developers in Medan City. The research was conducted at the Regional I Housing Office of Perum Perumnas by collecting data and conducting interviews to complete this research. This type of research in this scientific paper uses normative legal research. The buying and selling mechanism through the developer is regulated by using a Sale and Purchase Binding agreement which is valid and has legal force and is binding if it is based on the provisions of Article 1320 of the Civil Code, by fulfilling all requirements including conditions, namely the presence of words and skills of the parties as well as objective requirements covering certain matters. as well as halal causes. The obstacle that often occurs in the implementation of the Sale and Purchase Deed is the purchase ability of the buyer who is not sufficient to make purchases in cash. As well as providing legal certainty for housing consumers that what is in the agreement made must be in accordance with the goods and/or services agreed upon. Consumers as users of goods and/or services in this case houses or dwellings are entitled to the responsibility of housing developers if the housing they buy has defects, damage that results in losses. | en_US |
