dc.description.abstract | Pada era saat ini, Perusahaan berusaha agar melakukan efisiensi biaya produksi dalam melakukan kegiatannya. Salah satu caranya adalah dengan melakukan outsourcing atau memborongkan satu bagian atau sebagian kegiatan perusahaan kepada perusahaan lain. Kegiatan outsourcing dapat dilakukan dengan adanya perjanjian kerja, yang menghasilkan hubungan kerja. Dalam hubungan kerja, sering terjadi perselisihan antara kedua pihak. Perselisihan yang timbul tersebut disebut dengan Perselisihan Hubungan Industrial. Permasalahan yang diangkat dalam penelitian ini adalah bagaimana pengaturan hukum tentang penyerahan sebagian pelaksanaan pekerjaan kepada perusahaan lain di Indonesia. Bagaimana bentuk perlindungan hukum terhadap pekerja pada perusahaan outsourcing dengan Perjanjian Kerja Waktu Tertentu. Bagaimana upaya penyelesaian sengketa pemutusan hubungan kerja pada perusahaan outsourcing di Kota Medan. Metode penelitian dalam skripsi ini adalah yuridis normatif. Data yang digunakan adalah data primer yaitu data yang didapat secara langsung di lapangan dengan mengajukan wawancara ke Dinas Ketenagakerjaan Kota Medan, dan data skunder berupa dokumen resmi, buku, jurnal, undang-undang serta hasil penelitian. Dinas Ketenagakerjaan Kota Medan memfasilitasi dan membantu dalam upaya penyelesaian sengketa hubungan industrial di Kota Medan. Dinas Ketenagakerjaan membantu para pihak yang bersengketa menyelesaikan perselisihan dengan bipartit, mediasi atau konsiliasi, hingga pengadilan hubungan industrial. Peraturan yang mengatur mengenai ketenagakerjaan yaitu Undang- Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Peraturan Pemerintah Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja. Ketentuan mengenai sistem alih daya lebih rinci diatur dalam Peraturan Pemerintah Nomor 35 Tahun 2021. In this era, the company strives to make production cost-efficient in carrying out its activities. One way is by taking outsourcing or by buying out one part or part of the company's activities to other companies. Outsourcing activities can be carried out with a work agreement which results in an employment relationship. In working relationships, there are often disputes between the two parties. The resulting dispute is called an Industrial Relations Dispute. The problems in this research were how the legal arrangements regarding the delivery of part of the work implementation to other companies in Indonesia was, what form of legal protection for workers in outsourcing companies with a Specific Time Work Agreement was, and how to resolve disputes over the termination of employment at outsourcing companies in Medan City was. The research method in this thesis was normative juridical. The data used were primary data which data obtained directly in the field by submitting interviews to the Manpower Office of Medan City, and secondary data which was in the form of official documents, books, journals, laws, and research results. The Manpower Office of Medan City facilitated and assisted in efforts to resolve industrial relations disputes in Medan City. The Manpower Office assisted the disputing parties in resolving disputes by bipartite, mediation/conciliation, to the industrial relations court. The regulations governing employment were Law Number 13 of 2003 concerning Manpower, Government Regulation Number 35 of 2021 concerning Work Agreements for Certain Time, Outsourcing, Working Time and Rest Time, and Termination of Employment. More detailed provisions regarding the outsourcing system were regulated in Government Regulation Number 35 of 2021. | en_US |
