dc.description.abstract | PT. Pegadaian (Persero) adalah salah satu Lembaga Keuangan Non Bank yang menyalurkan jasa kredit peminjaman modal atau uang dengan jaminan. Penyebaran Corona Virus Disease 2019 (Covid-19) mengakibatkan Pegadaian melakukan restrukturisasi kredit guna menjaga rasio kredit macet (Non Performing Loan). Permasalahan dalam penelitian ini meliputi bagaimana pengaturan hukum restrukturisasi kredit terhadap lembaga jasa keuangan nonbank pada masa pandemi Covid-19, Bagaimana penerapan restrukturisasi kredit macet pada PT Pegadaian (Persero), Bagaimana proses penyelesaian restrukturisasi kredit macet pada PT Pegadaian (Persero), Adapun metode yang digunakan dalam penelitian ini adalah penelitian yuridis normatif. Pendekatan yang dilakukan dalam penelitian ini menggunakan deskriptif analisis yang mengarah kepada penelitian hukum normatif. Teknik pengumpulan data dilakukan dengan dua cara, pertama penelitian kepustakaan (library research), dan kedua penelitian lapangan (field research) dengan cara wawancara. Penelitian ini menggunakan analisa data secara deskriptif. Berdasarkan hasil penelitian yang diperoleh pengaturan hukum terhadap restrukturisasi kredit adalah Peraturan OJK (PJOK) Nomor 30/POJK.05/2021 tentang Perubahan Kedua atas Peraturan Otoritas Jasa Keuangan Nomor (PJOK) 14/POJK.05/2020 tentang Kebijakan Countercyclical Dampak Penyebaran Coronavirus Disease (Covid) 2019 bagi Lembaga Jasa Keuangan Nonbank. Penerapan restrukturisasi kredit yang dilakukan PT Pegadaian Kanwil I Medan selain menggunakan mekanisme yang diarahkan pemerintah juga mengacu pada Peraturan Direksi PT Pegadaian Nomor 134 Tahun 2020 Tentang Pedoman Restrukturisasi Kredit dengan tetap memperhatikan penilaian kualitas aset nasabah. Dimana penyelesaian kredit macet oleh PT Pegadaian Kanwil I Medan dapat dilakukan dengan beberapa cara yaitu, melakukan penjadwalan ulang, perubahan sebagian atau seluruh syarat pembiayaan dan melakukan penataan kembali. Apabila setelah dilakukan restrukturisasi tetapi kredit tetap tidak terselamatkan maka langkah yang dilakukan peringatan persuatif, peringatan somasi dan eksekusi jaminan. PT. Pegadaian (Persero) is one of the Non-Bank Financial Institutions that provide credit services for capital loaning or money with collateral. The spread of Corona Virus Disease 2019 (Covid-19) has caused Pegadaian to restructure loans to maintain the ratio of non-performing loans. The problems in this study were how the legal arrangement for credit restructuring for non-bank financial service institutions during the Covid-19 pandemic was, how the implementation of nonperforming loans restructuring at PT. Pegadaian (Persero) was, and how the process of completing the restructuring of non-performing loans at PT. Pegadaian (Persero) was. The method used in this research was normative juridical research. The approach carried out in this study used descriptive analysis that led to normative legal research. Data collection techniques were carried out in two ways, library research, and field research which conducted interviews. This research used descriptive data analysis. Based on the results, the legal regulation on credit restructuring was Financial Services Authority Regulation/Peraturan Jasa Otoritas Keuangan (PJOK) Number 30/POJK.05/2021 concerning the Second Amendment to Financial Services Authority Regulation/Peraturan Jasa Otoritas Keuangan (PJOK) Number 14/POJK.05/2020 concerning Countercyclical Policy on the Impact of the Coronavirus Disease (Covid) 2019 Spread for Non-Bank Financial Services Institutions. The implementation of loans restructuring carried out by PT. Pegadaian Regional Office I Medan was not only use a mechanism directed by the government but it also referred to the Regulation of the Directors Board of PT. Pegadaian Number 134 of 2020 concerning Guidelines for Loans Restructuring by still paying attention to the assessment of customer asset quality. It was where the settlement of non-performing loans by PT. Pegadaian Regional Office I Medan could be done in several ways, namely, rescheduling, changing part or all of the financing terms, and rearranging. If it was restructured the loans were still not saved, then the steps taken were persuasive warnings, subpoena warnings, and bail execution. | en_US |
