dc.description.abstractDiskresi Kepolsian adalah suatu kebijakan yang diambil Kepolisian sebagai jalan keluar untuk menyelesaikan suatu masalah berdasarkan penilaiannya sendiri atas permasalah yang sudah atau belum diatur dalam hukum termaksud dalam penyelesaian tindak pidana pencabulan oleh anak, Pentingnya diskresi Kepolisian ini Dikarenakan anak yang sudah berstatus narapidana, dikhawatirkan akan mem-berikan dampak negatif yang dapat mempengaruhi mental dan jiwa anak yang ber-sangkutan. Permasalahan dalam penelitian ini adalah Bagaimana pengaturan hukum tentang diskresi Kepolisian terhadap tindak pidana pencabulan oleh anak, Bagaimana penerapan diskresi Kepolisian terhadap tindak pidana pencabulan oleh anak di Polrestabes Medan. Metode penelitian yang digunakan adalah yuridis nor-matif yang mencakup penelitian terhadap aplikasi diskresi Kepolisian terhadap pelaku pencabulan oleh anak di Polrestabes Medan dengan pendekatan secara kualitatif. Hasil penelitian adalah Pengaturan hukum tentang diskresi Kepolisian terhadap tindak pencabulan oleh anak diatur dalam Undang – Undang Nomor 2 tahun 2002 tentang Kepolisian Negara Republik Indonesia, Penerapan diskresi Kepolisian terhadap tindak pidana pencabulan oleh anak di Polrestabes Medan secara konsisten berupaya menerapkan asas kepentingan terbaik untuk anak dan mengedepankan keadilan restoratif, tetapi kendala dalam penerapan diskresi adalah ketidak setujuan salah satu pihak dengan keputusan Kepolisian sehingga berdam-pak pada kasus yang selanjutnya diselesaikan secara litigasi. Police discretion is a policy taken by the Police as a solution to resolve a problem based on its assessment of problems that have been or have not been reg-ulated in the law, including the settlement of criminal acts of molestation by chil-dren. The importance of this Police discretion was due to the children who were already prisoners; it was worried that it would have a negative impact that could affect the mental and soul of the children. The problems in this study were how the legal arrangements regarding the police's discretion against the crime of molestation by children, and how the application of the police's discretion to the crime of mo-lestation by children was at the Big City Resort Police of Medan. The research method used was normative juridical which included research on the application of police discretion to perpetrators of molestation by children at the Big City Resort Police of Medan with a qualitative approach. The results of the study were the legal regulation regarding police discretion against acts of molestation by children was regulated in Law No. 2 of 2002 concerning the Indonesian National Police, priori-tizing restorative justice, but the obstacle in the application of discretion was the disagreement of one party with the police decision so that it had an impact on cases which were subsequently resolved by litigation.en_US
