Abstract: | Pembangunan untuk kepentingan umum pada Pelabuhan Terminal Multipurpose Kualatanjung Di Kabupaten Batubara merupakan Proyek Strategis Nasional. Tujuan penelitian adalah untuk menganalisis penerapan UU Nomor 2 Tahun 2012 untuk kepentingan umum terhadap proses pemberian ganti kerugiaan atas tanah pada pengadaan tanah bagi pembangunan untuk kepentingan umum dalam pembangunan Pelabuhan Terminal Multipurpose Kualatanjung di Kabupaten Batubara, kendala-kendala yang dihadapi selama proses ganti kerugian dan solusi yang dapat diberikan terhadap pelaksanaan ganti kerugiaan yang dilaksanakan Kantor Pertanahan pada Proses pengadaan tanah bagi Pembangunan untuk kepentingan umum pada Pelabuhan Terminal Multipurpose Kualatanjung Di Kabupaten Batubara. Adapun metode penelitian yang digunakan adalah penelitian hukum normatif, dengan instrumen pengumpulan data yaitu wawancara dan dokumentasi. Analisis data menggunakan deskriptif analisis. Berdasarkan penelitian, Penerapan UU Nomor 2 Tahun 2012 terhadap proses pemberian ganti kerugiaan atas tanah pada pengadaan tanah dalam pembangunan Pelabuhan Terminal Multipurpose Kualatanjung di Kabupaten diselenggarakan melalui: a. Perencanaan, b. Persiapan, c. pelaksanaan, d. penyerahan hasil. Kendala-kendala yang dihadapi selama proses ganti kerugian proses pengadaan tanah pembangunan Pelabuhan Terminal Multipurpose Kualatanjung diKabupaten Batubara yaitu: a. Kurangnya kesadaran dan pemahaman warga masyarakat terhadap artinya pembangunan bagi kepentingan umum, b. penolakan atas besaran ganti rugi, c. adanya masyarakat yang tidak memiliki alas hak tanah, d. banyak masyarakat tidak menghadiri proses pengukuran bidang tanah, e. adanya sengketa atas objek tanah yang dikuasai pemilik tanah dengan pihak lain yang belum diselesaikan. Solusi yang dapat diberikan Kantor Pertanahan pada Proses pengadaan tanah Pelabuhan Terminal Multipurpose Kualatanjung Di Kabupaten Batubara ada 3 cara: 1) Musyawarah, 2) Mediasi, 3) Konsinyasi, terdapat 79 orang masyarakat yang menolak atau tidak dapat menerima ganti rugi. Solusi terhadap kendala-kendala pengadaan tanah pembangunan untuk kepentingan umum Pelabuhan Terminal Multipurpose Kualatanjung sangat dibutuhkan dalam menyelesaikan perselisihan yang terjadi, sehingga masyarakat dan Pelindo harus menghasilkan kesepakatan yang benar-benar menghasilkan rasa keadilan sesuai dengan harapan masyarakat. The development for the public interest at the Kualatanjung Multipurpose Terminal Port in Batubara Regency is a National Strategic Project. The purpose of the study was to analyze the application of Law Number 2 of 2012 in the public interest to the process of providing compensation for land in land acquisition for development for the public interest in the construction of the Kualatanjung Multipurpose Terminal Port in Batubara Regency, the obstacles encountered during the compensation process and solutions. which can be given to the implementation of compensation carried out by the Land Office in the process of land acquisition for development for the public interest at the Kualatanjung Multipurpose Terminal Port in Batubara Regency. The research method used is normative legal research, with data collection instruments, namely interviews and documentation. Data analysis used descriptive analysis. Based on the research, the application of Law No. 2 of 2012 on the process of providing compensation for land on land acquisition in the construction of the Kualatanjung Multipurpose Terminal Port in the Regency is carried out through: a. Planning, b. Preparation, c. implementation, d. submission of results. The obstacles faced during the compensation process for the land acquisition process for the construction of the Kualatanjung Multipurpose Terminal Port in Batubara Regency, namely: a. Lack of awareness and understanding of community members about the meaning of development for the public interest, b. rejection of the amount of compensation, c. there are people who do not have land rights, d. many communities did not attend the land parcel measurement process, e. there are disputes over land objects controlled by land owners with other parties that have not been resolved. The solution that the Land Office can provide in the land acquisition process for the Kualatanjung Multipurpose Terminal Port in Batubara Regency is in 3 ways: 1) Deliberation, 2) Mediation, 3) Consignment, there are 79 people who refuse or cannot accept compensation. Solutions to the obstacles to land acquisition for development for the public interest of the Kualatanjung Multipurpose Terminal Port are urgently needed in resolving disputes that occur, so that the community and Pelindo must come to an agreement that truly produces a sense of justice in accordance with community expectations. |
