Abstract: Tesis ini berjudul “Kajian Hukum Mengenai Penanganan Anak yang Melakukan Penyalahgunaan Narkotika di Direktorat Reserse Narkoba Kepolisian Daerah Sumatera Utara”. Penulisan tesis ini bertujuan untuk mengkaji dan menganalisis aturan hukum mengenai penanganan anak yang melakukan tindak pidana penyalahgunaan narkotika di Direktorat Reserse Narkoba Kepolisian Daerah Sumatera Utara. Metode penelitian yang digunakan adalah penelitian yuridis normative dengan menggunakan pendekatan perundang-undangan (statute approach) yaitu dilakukan dengan menelaah ketentuan perundang-undangan yang berlaku yaitu UU No. 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Hasil penelitian yang diperoleh menunjukan bahwa Aturan hukum tentang penanganan anak diatur dalam UU SPPA No 11 Tahun 2012, dimana dalam UU tersebut bahwa penanganan anak harus mengedepankan perlindungan terhadap anak. Kebijakan terhadap penanganan anak harus mengupayakan pendekatan restoratif, sehingga dapat menghindari anak dari pemidanaan yang dapat mengganggu masa depan anak. Penanganan anak selama proses pidana juga harus memperhatikan kebutuhan anak sehingga tidak mengganggu perkembangan anak baik secara mental maupun secara fisik. Adapun factor penyebab terjadinya penyalahgunaan narkotika yang dilakukan oleh anak di Wilayah Hukum Kepolisian Daerah Sumatera Utara adalah: kurangnya pengawasan orang tua, factor ikut-ikutan, secara sengaja dimanfaatkan oleh bandar narkotika, peredaran narkotika yang semakin tidak terkendali hingga sangat dekat dengan lingkungan pergaulan anak-anak sehari-hari, serta masih kurangnya pemahaman anak terhadap bahaya narkotika. Kebijakan penanganan anak yang melakukan tindak pidana penyalahgunaan narkotika di Kepolisian Daerah Sumatera Utara berpedoman pada UU SPPA No 11 Tahun 2012. Kepolisian berupaya memenuhi hak-hak anak selama proses penyidikan, serta mengupayakan penyelesaian perkara melalui diversi. Tetapi upaya penyidik masih belum maksimum karena ternyata masih banyak pelanggaran terhadap hak-hak anak dan juga masih banyak anak pemakai narkotika yang diproses melalui peradilan pidana. This thesis is entitled "Legal Studies Concerning the Handling of Children Who Abuse Narcotics at the Directorate of Drug Investigation of the North Sumatra Police". The purpose of writing this thesis is to examine and analyze the legal rules regarding the handling of children who commit criminal acts of narcotics abuse at the Directorate of Drug Investigation of the North Sumatra Regional Police. The research method used is normative juridical research using a statute approach, which is carried out by examining the provisions of the applicable legislation, namely Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. The results of the research obtained indicate that the rule of law regarding the handling of children is regulated in the SPPA Law No. 11 of 2012, where in the law that the handling of children must prioritize the protection of children. Policies for handling children must seek a restorative approach, so as to prevent children from being punished which can disrupt the child's future. Handling children during the criminal process must also pay attention to the needs of the child so that it does not interfere with the child's development both mentally and physically. The factors that cause narcotics abuse by children in the North Sumatra Regional Police Legal Area are: lack of parental supervision, follow-up factors, intentionally being used by narcotics dealers, narcotics circulation that is getting out of control until it is very close to the social environment of children. everyday life, as well as the lack of children's understanding of the dangers of narcotics. Policies for handling children who commit criminal acts of narcotics abuse in the North Sumatra Regional Police are guided by the SPPA Law No. 11 of 2012. The police strive to fulfill the rights of children during the investigation process, and seek to resolve cases through diversion. But the efforts of investigators are still not maximized because it turns out that there are still many violations of children's rights and there are also many children who use narcotics who are processed through criminal justice.
