Penegakan Hukum Pidana Terhadap Pungutan Liar Di Wilayah Hukum Patumbak (Studi Kasus Di Polsek Patumbak)

Abstract

Belakangan ini sering diperbincangkan masalah pungli yang berkembang menjadi penyakit di masyarakat, akibatnya masyarakat menjadi resah. Kasus pungli yang viral di mediasosial, pelaku berisial A telah melakukan aksinya disertai dengan memaki (Berkata Kasar) kepada supir maupun kenek truk yang melintas dijalan pertahanan tersebut. Permasalahan dalam kasus inu adalah apa saja faktor penyebab pungli tersebut, bagaimana penegakan hukum pidana oleh Polsek Patumbak terhadap pungli diwilayah hukum patumbak dan bagaimana kendala yang dihadapi Polsek Patumbak dalam menanggulangi pungli tersebut. Metode yang digunakan adalah penelitian yuridis empiris karena penelitian ini mengkaji suatu ketentuan dalam hukum yang dilaksanakan dan bagaimana hukum itu bersesuaian dengan kehidupan masyarakat. Hasil penelitian ini bahwa faktor penyebab pungli di wilayah hukum Patumbak disebabkan oleh beberapa hal, dimana faktor tersebut juga didorong oleh faktor internal yang mempengaruhinya, serta penyalahgunaan jabatan atau wewenang sehingga muncul niat untuk melanggar norma hukum. Upaya yang dilakukan Polsek Patumbak dalam menangani kasus pungli khusunya diwilayah Patumbak dengan memperbanyak sosialisasi secara tatap muka tentang pungli, karena dengan dilakukannya sosialisasi tersebut dalam masyarakat dapat menegakan hukun terhadap pungli. Kendala yang dihadapi Polsek Patumbak dalam menanggulangi pungli diwilayah hukum patumbak yaitu, kurangnya sosialisasi atau penyuluhan yang dilakukan polsek atau saber pungli, sehingga masyarakat setempat kurang memahami tentang pungli. Kurangnya pengawasan dari penegak hukum yang mempunyai wewenang serta kurangnya kesadaran dan kepatuhan masyarakat terhadap hukum. Lately, the issue of extortion has often been discussed, which has developed into a disease in society, as a result, people have become restless. In the case of illegal extortion that went viral on social media, the perpetrator A had carried out the action accompanied by swearing at the driver and driver of the truck that crossed the defense road. The problem in this case is what are the factors that cause extortion, how is the enforcement of criminal law by the Patumbak Police against extortion in the Patumbak jurisdiction and what are the obstacles faced by the Patumbak Police in tackling the extortion. The method used is empirical juridical research because this research examines a provision in the law that is implemented and how the law is in accordance with people's lives. The results of this study show that the factors that cause extortion in the Patumbak jurisdiction are caused by several things, where these factors are also driven by internal factors that influence it, as well as abuse of office or authority so that an intention to violate legal norms arises. Efforts made by the Patumbak Police in dealing with cases of extortion, especially in the Patumbak area, are by increasing face-to-face socialization about extortion, because by doing this socialization in society it can enforce laws against extortion. The obstacle faced by the Patumbak Police in tackling extortion in the Patumbak jurisdiction is the lack of outreach or counseling by the police or saber extortion, so that the local community does not understand extortion. Lack of supervision from law enforcers who have authority and lack of public awareness and compliance with the law.
