Abstract: Kegiatan pertambangan di atur secara khusus dalam Undang-Undang Republik Indonesia Nomor 4 Tahun 2009 Tentang Pertambangan, Mineral dan Batubara. Dalam peraturan tersebut diatur ketentuan pidana didalam Bab XXIII Pasal 158 sampai Pasal 165. Ketentuan pidana yang terdapat didalam undang-undang ini banyak mengatur persoalan izin yaitu Izin Usaha Pertambangan (IUP), Izin Pertambangan Rakyat (IPR), dan Izin Usaha Pertambangan Khusus (IUPK). Kegiatan pertambangan di Indonesia dilakukan oleh perusahaan tambangyang telah memliliki izin resmi. Akan tetapi tidak jarang juga ditemukan pelaku-pelaku usaha yang melakukan kegiatan usaha dibidang tambang yang tidak memiliki izin resmi. Jenis penelitian yang digunakan adalah penelitian hukum normatif didukung dengan data lapangan melalui wawancara kepada penyidik di Kepolisian Resor Kota Besar Medan. Analisis data dalam penelitian ini dilakakukan dengan cara memilih data sekunder hasil penelitian kepustakaan dan data penelitian lapangan dianalisis secara kualitatif. Terdapat kesimpulan dari hasil penelitian ini yaitu, Urgensi pemidanaan terhadap pelaku usaha yang melakukan usaha pertambangan tanpa izin di Indonesia yaitu untuk membalas kesalahan penjahat juga dimaksudkan untuk melindungi masyarakat, dengan mewujudkan ketertiban dalam menjalankan kegiatan usaha pertambangan. Penegakan hukum terhadap pelaku usaha yang melakukan usaha pertambangan tanpa izin dalam putusan Nomor: 517/Pid.B/2021/PN.Lbp belum optimal dan tidak mencerminkan rasa keadilan. Faktor penyebab terjadinya kasus pertambangan tanpa izin di Kabupaten Deli Serdang terbagi 2 (dua) yaitu, faktor internal dan faktor eksternal. Faktor Internal terdiri atas faktor pendidikan dan faktor ekonomi. Pada Faktor eksternal dikarenakan kurangnya sosialisasi terkait izin usaha pertambangan dan pengurusan izin usaha pertambangan yang rumit. Mining activities are specifically regulated in the Law of the Republic of Indonesia Number 4 of 2009 concerning Mining, Minerals and Coal. The regulation regulates criminal provisions in Chapter XXIII Article 158 to Article 165. The criminal provisions contained in this law deal with permit issues, namely Mining Business Permits (IUP), People's Mining Permits (IPR), and Special Mining Business Permits (IUPK). ). Mining activities in Indonesia are carried out by mining companies that have official permits. However, it is not uncommon to find business actors conducting business activities in the mining sector who do not have official permits. The type of research used is normative legal research supported by field data through interviews with investigators at the Medan Metropolitan Police. Data analysis in this study was carried out by selecting secondary data from library research and field research data analyzed qualitatively. There is a conclusion from the results of this study, namely, the urgency of criminalizing business actors who carry out mining business without a permit in Indonesia, namely to avenge the mistakes of criminals is also intended to protect the public, by creating order in carrying out mining business activities. Law enforcement against business actors who carry out mining business without a mining business permit in decision Number: 517/Pid.B/2021/PN.Lbp is not optimal and does not reflect a sense of justice. Factors causing the occurrence of cases of mining without a mining business permit in Deli Serdang Regency are divided into 2 (two), namely, internal factors and external factors. Internal factors consist of educational factors and economic factors. On external factors due to the lack of socialization related to mining business licenses and the complicated management of mining business permits.
